SYNOPSIS AS INTRODUCED:
 
20 ILCS 1605/7.12

    Amends the Illinois Lottery Law. Provides that the Department of the Lottery may offer interactive instant win games through the Internet program. Provides that the Director of the Lottery shall not approve and the Department shall not offer any interactive instant win game that qualifies as a gambling game. Removes a provision that repeals provisions concerning the Internet program on July 1, 2025. Makes other changes. Defines terms. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 7.12 as follows:
 
6    (20 ILCS 1605/7.12)
7    (Section scheduled to be repealed on July 1, 2025)
8    Sec. 7.12. Internet program.
9    (a) The General Assembly finds that:
10        (1) the consumer market in Illinois has changed since
11    the creation of the Illinois State Lottery in 1974;
12        (2) the Internet has become an integral part of
13    everyday life for a significant number of Illinois
14    residents not only in regards to their professional life,
15    but also in regards to personal business and
16    communication; and
17        (3) the current practices of selling lottery tickets
18    does not appeal to the new form of market participants who
19    prefer to make purchases on the Internet at their own
20    convenience.
21    It is the intent of the General Assembly to create an
22Internet program for the sale of lottery tickets to capture
23this new form of market participant.

1    (b) The Department shall create a program that allows an
2individual 18 years of age or older to purchase lottery
3tickets or shares on the Internet without using a Lottery
4retailer with on-line status, as those terms are defined by
5rule. The Department shall restrict the sale of lottery
6tickets on the Internet to transactions initiated and received
7or otherwise made exclusively within the State of Illinois.
8The Department shall adopt rules necessary for the
9administration of this program. These rules shall include,
10among other things, requirements for marketing of the Lottery
11to infrequent players, as well as limitations on the purchases
12that may be made through any one individual's lottery account.
13The provisions of this Act and the rules adopted under this Act
14shall apply to the sale of lottery tickets or shares under this
15program.
16    The Department is obligated to implement the program set
17forth in this Section and Sections 7.15 and 7.16. The
18Department may offer Lotto, Lucky Day Lotto, Mega Millions,
19Powerball, Pick 3, Pick 4, and other draw games that are
20offered at retail locations and interactive instant win games
21through the Internet program. The private manager shall obtain
22the Director's approval before providing any draw games or an
23interactive instant win game. The Director shall not approve
24and the Department shall not offer any interactive instant win
25game that qualifies as a gambling game. Any draw game tickets
26that are approved for sale by lottery licensees are

1automatically approved for sale through the Internet program.
2The Department shall maintain responsible gaming controls in
3its policies.
4    The Department shall authorize the private manager to
5implement and administer the program pursuant to the
6management agreement entered into under Section 9.1 and in a
7manner consistent with the provisions of this Section. If a
8private manager has not been selected pursuant to Section 9.1
9at the time the Department is obligated to implement the
10program, then the Department shall not proceed with the
11program until after the selection of the private manager, at
12which time the Department shall authorize the private manager
13to implement and administer the program pursuant to the
14management agreement entered into under Section 9.1 and in a
15manner consistent with the provisions of this Section.
16    Nothing in this Section shall be construed as prohibiting
17the Department from implementing and operating a website
18portal whereby individuals who are 18 years of age or older
19with an Illinois mailing address may apply to purchase lottery
20tickets via subscription. Nothing in this Section shall also
21be construed as prohibiting the Lottery draw game tickets
22authorized for sale through the Internet program under this
23Section from also continuing to be sold at retail locations by
24a lottery licensee pursuant to the Department's rules.
25    (c) (Blank).
26    (d) (Blank). This Section is repealed on July 1, 2025.

1    (e) As used in this Section:
2    "Gambling game" has the meaning set forth in Section 4 of
3the Illinois Gambling Act.
4    "Interactive instant win game" means a virtual lottery
5instant game with specified prize structures and set odds that
6does not include an instant-reveal function that immediately
7reveals the outcome of the game.

9    Section 99. Effective date. This Act takes effect upon
10becoming law.
