SYNOPSIS AS INTRODUCED:
 
225 ILCS 85/45 new

    Amends the Pharmacy Practice Act. Provides that a pharmacy shall inform a patient if the pharmacy releases the patient's records to any person or entity without the patient's written consent. Provides that a pharmacy shall create and publish an annual report containing the number of patient information requests, including subpoenas and warrants, that the pharmacy received and how many of those requests the pharmacy fulfilled during the preceding calendar year. Provides that the Department of Financial and Professional Regulation shall adopt rules to implement and administer these provisions.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Pharmacy Practice Act is amended by adding
5Section 45 as follows:
 
6    (225 ILCS 85/45 new)
7    Sec. 45. Patient records; release and report.
8    (a) A pharmacy shall inform a patient if the pharmacy
9releases the patient's records to any person or entity without
10the patient's written consent.
11    (b) A pharmacy shall create and publish an annual report
12containing the number of patient information requests,
13including subpoenas and warrants, that the pharmacy received
14and how many of those requests the pharmacy fulfilled during
15the preceding calendar year.
16    (c) The Department shall adopt rules to implement and
17administer this Section.
