1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Sections 1A-16, 1A-45, 3-6, 4-2, 4-23, 5-2, 5-29.01, 6-27,
66-62, 6-67.01, 7-10, 7-45, 8-8, 10-4, 17-9, 17-10, 18A-5,
720-3, and 28-3 as follows:
 
8    (10 ILCS 5/1A-16)
9    Sec. 1A-16. Voter registration information; Internet
10posting; processing of voter registration forms; content of
11such forms. Notwithstanding any law to the contrary, the
12following provisions shall apply to voter registration under
13this Code.
14    (a) Voter registration information; Internet posting of
15voter registration form. Within 90 days after August 21, 2003
16(the effective date of Public Act 93-574), the State Board of
17Elections shall post on its World Wide Web site the following
18information:
19        (1) A comprehensive list of the names, addresses,
20    phone numbers, and websites, if applicable, of all county
21    clerks and boards of election commissioners in Illinois.
22        (2) A schedule of upcoming elections and the deadline
23    for voter registration.

1        (3) A downloadable, printable voter registration form,
2    in at least English and in Spanish versions, that a person
3    may complete and mail or submit to the State Board of
4    Elections or the appropriate county clerk or board of
5    election commissioners.
6Any forms described under paragraph (3) must state the
7following:
8        If you do not have a driver's license or social
9    security number, and this form is submitted by mail, and
10    you have never registered to vote in the jurisdiction you
11    are now registering in, then you must send, with this
12    application, either (i) a copy of a current and valid
13    photo identification, or (ii) a copy of a current utility
14    bill, bank statement, government check, paycheck, or other
15    government document that shows the name and address of the
16    voter. If you do not provide the information required
17    above, then you will be required to provide election
18    officials with either (i) or (ii) described above the
19    first time you vote at a voting place.
20    (b) Acceptance of registration forms by the State Board of
21Elections and county clerks and board of election
22commissioners. The State Board of Elections, county clerks,
23and board of election commissioners shall accept all completed
24voter registration forms described in subsection (a)(3) of
25this Section and Section 1A-17 and voter registration forms
26created under Section 30 of the Address Confidentiality for

1Victims of Domestic Violence, Sexual Assault, Human
2Trafficking, or Stalking Act that are:
3        (1) postmarked on or before the day that voter
4    registration is closed under this Code;
5        (2) not postmarked, but arrives no later than 5 days
6    after the close of registration;
7        (3) submitted in person by a person using the form on
8    or before the day that voter registration is closed under
9    this Code; or
10        (4) submitted in person by a person who submits one or
11    more forms on behalf of one or more persons who used the
12    form on or before the day that voter registration is
13    closed under this Code.
14    Upon the receipt of a registration form, the State Board
15of Elections shall mark the date on which the form was received
16and send the form via first class mail to the appropriate
17county clerk or board of election commissioners, as the case
18may be, within 2 business days based upon the home address of
19the person submitting the registration form. The county clerk
20and board of election commissioners shall accept and process
21any form received from the State Board of Elections.
22    (c) Processing of registration forms by county clerks and
23boards of election commissioners. The county clerk or board of
24election commissioners shall promulgate procedures for
25processing the voter registration form.
26    (d) Contents of the voter registration form. The State

1Board shall create a voter registration form, which must
2contain the following content:
3        (1) Instructions for completing the form.
4        (2) A summary of the qualifications to register to
5    vote in Illinois.
6        (3) Instructions for mailing in or submitting the form
7    in person.
8        (4) The phone number for the State Board of Elections
9    should a person submitting the form have questions.
10        (5) A box for the person to check that explains one of
11    3 reasons for submitting the form:
12            (a) new registration;
13            (b) change of address; or
14            (c) change of name.
15        (6) a box for the person to check yes or no that asks,
16    "Are you a citizen of the United States?", a box for the
17    person to check yes or no that asks, "Will you be 16 18
18    years of age on or before election day?", and a statement
19    of "If you checked 'no' in response to either of these
20    questions, then do not complete this form.".
21        (7) A space for the person to fill in his or her home
22    telephone number.
23        (8) Spaces for the person to fill in his or her first,
24    middle, and last names, street address (principal place of
25    residence), county, city, state, and zip code.
26        (9) Spaces for the person to fill in his or her mailing

1    address, city, state, and zip code if different from his
2    or her principal place of residence.
3        (10) A space for the person to fill in his or her
4    Illinois driver's license number if the person has a
5    driver's license.
6        (11) A space for a person without a driver's license
7    to fill in the last four digits of his or her social
8    security number if the person has a social security
9    number.
10        (12) A space for a person without an Illinois driver's
11    license to fill in his or her identification number from
12    his or her State Identification card issued by the
13    Secretary of State.
14        (13) A space for the person to fill the name appearing
15    on his or her last voter registration, the street address
16    of his or her last registration, including the city,
17    county, state, and zip code.
18        (14) A space where the person swears or affirms the
19    following under penalty of perjury with his or her
20    signature:
21            (a) "I am a citizen of the United States.";
22            (b) "I will be at least 16 18 years old on or
23        before the next election.";
24            (c) "I will have lived in the State of Illinois and
25        in my election precinct at least 30 days as of the date
26        of the next election."; and

1            (d) "The information I have provided is true to
2        the best of my knowledge under penalty of perjury. If I
3        have provided false information, then I may be fined,
4        imprisoned, or, if I am not a U.S. citizen, deported
5        from or refused entry into the United States.".
6        (15) A space for the person to fill in his or her
7    e-mail address if he or she chooses to provide that
8    information.
9    (d-5) Compliance with federal law; rulemaking authority.
10The voter registration form described in this Section shall be
11consistent with the form prescribed by the Federal Election
12Commission under the National Voter Registration Act of 1993,
13P.L. 103-31, as amended from time to time, and the Help America
14Vote Act of 2002, P.L. 107-252, in all relevant respects. The
15State Board of Elections shall periodically update the form
16based on changes to federal or State law. The State Board of
17Elections shall promulgate any rules necessary for the
18implementation of this Section; provided that the rules
19comport with the letter and spirit of the National Voter
20Registration Act of 1993 and Help America Vote Act of 2002 and
21maximize the opportunity for a person to register to vote.
22    (d-10) No later than 90 days after the 2022 general
23election, the State Board of Elections shall permit applicants
24to choose between "male", "female", or "non-binary" when
25designating the applicant's sex on the voter registration
26form.

1    (e) Forms available in paper form. The State Board of
2Elections shall make the voter registration form available in
3regular paper stock and form in sufficient quantities for the
4general public. The State Board of Elections may provide the
5voter registration form to the Secretary of State, county
6clerks, boards of election commissioners, designated agencies
7of the State of Illinois, and any other person or entity
8designated to have these forms by this Code in regular paper
9stock and form or some other format deemed suitable by the
10Board. Each county clerk or board of election commissioners
11has the authority to design and print its own voter
12registration form so long as the form complies with the
13requirements of this Section. The State Board of Elections,
14county clerks, boards of election commissioners, or other
15designated agencies of the State of Illinois required to have
16these forms under this Code shall provide a member of the
17public with any reasonable number of forms that he or she may
18request. Nothing in this Section shall permit the State Board
19of Elections, county clerk, board of election commissioners,
20or other appropriate election official who may accept a voter
21registration form to refuse to accept a voter registration
22form because the form is printed on photocopier or regular
23paper stock and form.

1    (10 ILCS 5/1A-45)
2    Sec. 1A-45. Electronic Registration Information Center.
3    (a) The State Board of Elections shall enter into an
4agreement with the Electronic Registration Information Center
5effective no later than January 1, 2016, for the purpose of
6maintaining a statewide voter registration database. The State
7Board of Elections shall comply with the requirements of the
8Electronic Registration Information Center Membership
9Agreement. The State Board of Elections shall require a term
10in the Electronic Registration Information Center Membership
11Agreement that requires the State to share identification
12records contained in the Secretary of State's Driver Services
13Department and Vehicle Services Department, the Department of
14Human Services, the Department of Healthcare and Family
15Services, the Department on Aging, and the Department of
16Employment Security databases (excluding those fields
17unrelated to voter eligibility, such as income or health
18information).
19    (b) The Secretary of State and the State Board of
20Elections shall enter into an agreement to permit the
21Secretary of State to provide the State Board of Elections
22with any information required for compliance with the
23Electronic Registration Information Center Membership
24Agreement. The Secretary of State shall deliver this
25information as frequently as necessary for the State Board of
26Elections to comply with the Electronic Registration

1Information Center Membership Agreement.
2    (b-5) The State Board of Elections and the Department of
3Human Services, the Department of Healthcare and Family
4Services, the Department on Aging, and the Department of
5Employment Security shall enter into an agreement to require
6each department to provide the State Board of Elections with
7any information necessary to transmit member data under the
8Electronic Registration Information Center Membership
9Agreement. The director or secretary, as applicable, of each
10agency shall deliver this information on an annual basis to
11the State Board of Elections pursuant to the agreement between
12the entities.
13    (c) Any communication required to be delivered to a
14registrant or potential registrant pursuant to the Electronic
15Registration Information Center Membership Agreement shall
16include at least the following message:
17        "Our records show people at this address may not be
18    registered to vote at this address, but you may be
19    eligible to register to vote or re-register to vote at
20    this address. If you are a U.S. Citizen, a resident of
21    Illinois, and will be 16 18 years old or older before the
22    next general election in November, you are qualified to
23    vote.
24        We invite you to check your registration online at
25    (enter URL) or register to vote online at (enter URL), by
26    requesting a mail-in voter registration form by (enter

1    instructions for requesting a mail-in voter registration
2    form), or visiting the (name of election authority) office
3    at (address of election authority)."
4    The words "register to vote online at (enter URL)" shall
5be bolded and of a distinct nature from the other words in the
6message required by this subsection (c).
7    (d) Any communication required to be delivered to a
8potential registrant that has been identified by the
9Electronic Registration Information Center as eligible to vote
10but who is not registered to vote in Illinois shall be prepared
11and disseminated at the direction of the State Board of
12Elections. All other communications with potential registrants
13or re-registrants pursuant to the Electronic Registration
14Information Center Membership Agreement shall be prepared and
15disseminated at the direction of the appropriate election
16authority.
17    (e) The Executive Director of the State Board of Elections
18or his or her designee shall serve as the Member
19Representative to the Electronic Registration Information
20Center.
21    (f) The State Board of Elections may adopt any rules
22necessary to enforce this Section or comply with the
23Electronic Registration Information Center Membership
24Agreement.

1    (10 ILCS 5/3-6)
2    Sec. 3-6. Voting age. Notwithstanding any other provision
3of law, a person who is 15 17 years old on the date of a
4caucus, general primary election, or consolidated primary
5election and who is otherwise qualified to vote is qualified
6to vote at that caucus, general primary, or consolidated
7primary, including voting a vote by mail, grace period, or
8early voting ballot with respect to that general primary or
9consolidated primary, if that person will be 16 18 years old on
10the date of the immediately following general election or
11consolidated election for which candidates are nominated at
12that primary.
13    References in this Code and elsewhere to the requirement
14that a person must be 16 18 years old to vote shall be
15interpreted in accordance with this Section, except that a
16person must be at least 18 years old to vote for federal
17officers.
18    For the purposes of this Code, an individual who is 15 17
19years of age and who will be 16 18 years of age on the date of
20the general or consolidated election shall be deemed competent
21to execute and attest to any voter registration forms. An
22individual who is 15 17 years of age, will be 16 18 years of
23age on the date of the immediately following general or
24consolidated election, and is otherwise qualified to vote
25shall be deemed eligible to circulate a nominating petition or
26a petition proposing a public question.

3    Sec. 4-2. No person shall be entitled to be registered in
4and from any precinct unless such person shall by the date of
5the election next following have resided in the State and
6within the precinct 30 days and be otherwise qualified to vote
7at such election. Every applicant who shall be 16 18 years of
8age or over on the day of the next election shall be permitted
9to register, if otherwise qualified.
10    To constitute residence under this Act, Article 3 is
11controlling.

19engaged in the military or naval service of the United States,
20and who appear personally at the polling place on election day
21and produce to the judges of election satisfactory evidence
22thereof, but such persons, if otherwise qualified to vote,
23shall be permitted to vote at such election without previous

9    The provisions of this Article 5, so far as they require
10the registration of voters as a condition to their being
11allowed to vote shall not apply to persons otherwise entitled
12to vote who have made and subscribed to the affidavit provided
13in paragraph (b) of Section 17-10 of this Act.

16    Sec. 6-27. Every person having resided in the State and in
17election precinct 30 days next preceding any election therein
18and who shall be a citizen of the United States of the age of
1916 18 or more years, shall be entitled to vote at such
20elections described in the last preceding Section.
21    After the first registration provided by this Article, the
22vote of no person, other than an elector voting pursuant to
23Article 20 of this Act or exempt under Section 6-67.01 or
246-67.02 of this Article from registration, shall be received
25in any election conducted under the provisions of this Article

2registered under the provisions of this Article in the

7next following, have resided in the State and within the
8precinct for 30 days, and be otherwise qualified to vote at
9such election. Every applicant who shall be 16 18 years of age
10on the day of the next election shall be permitted to register,
11if otherwise qualified.

3signed; the office, the political party represented and place
4of residence; and the heading of each sheet shall be the same.
5    Such petition shall be signed by qualified primary
6electors residing in the political division for which the
7nomination is sought in their own proper persons only and
8opposite the signature of each signer, his residence address
9shall be written or printed. The residence address required to
10be written or printed opposite each qualified primary
11elector's name shall include the street address or rural route
12number of the signer, as the case may be, as well as the
13signer's county, and city, village or town, and state.
14However, the county or city, village or town, and state of
15residence of the electors may be printed on the petition forms
16where all of the electors signing the petition reside in the
17same county or city, village or town, and state. Standard
18abbreviations may be used in writing the residence address,
19including street number, if any. At the bottom of each sheet of
20such petition shall be added a circulator statement signed by
21a person 16 18 years of age or older who is a citizen of the
22United States, stating the street address or rural route
23number, as the case may be, as well as the county, city,
24village or town, and state; and certifying that the signatures
25on that sheet of the petition were signed in his or her

7for the 2022 general primary election only, certify that the
8signatures on the sheet were signed during the period of
9January 13, 2022 through March 14, 2022 or certify that the

18    Except as otherwise provided in this Code, no petition
19sheet shall be circulated more than 90 days preceding the last
20day provided in Section 7-12 for the filing of such petition.
21    The person circulating the petition, or the candidate on
22whose behalf the petition is circulated, may strike any
23signature from the petition, provided that:
24        (1) the person striking the signature shall initial
25    the petition at the place where the signature is struck;

1        (2) the person striking the signature shall sign a
2    certification listing the page number and line number of
3    each signature struck from the petition. Such
4    certification shall be filed as a part of the petition.
5    Such sheets before being filed shall be neatly fastened
6together in book form, by placing the sheets in a pile and
7fastening them together at one edge in a secure and suitable
8manner, and the sheets shall then be numbered consecutively.
9The sheets shall not be fastened by pasting them together end
10to end, so as to form a continuous strip or roll. All petition
11sheets which are filed with the proper local election
12officials, election authorities or the State Board of
13Elections shall be the original sheets which have been signed
14by the voters and by the circulator thereof, and not
15photocopies or duplicates of such sheets. Each petition must
16include as a part thereof, a statement of candidacy for each of
17the candidates filing, or in whose behalf the petition is
18filed. This statement shall set out the address of such
19candidate, the office for which he is a candidate, shall state
20that the candidate is a qualified primary voter of the party to
21which the petition relates and is qualified for the office
22specified (in the case of a candidate for State's Attorney it
23shall state that the candidate is at the time of filing such
24statement a licensed attorney-at-law of this State), shall
25state that he has filed (or will file before the close of the

13to, and no signatures shall be revoked except by revocation
14filed in writing with the State Board of Elections, election
15authority or local election official with whom the petition is
16required to be filed, and before the filing of such petition.
17Whoever forges the name of a signer upon any petition required
18by this Article is deemed guilty of a forgery and on conviction
19thereof shall be punished accordingly.
20    A candidate for the offices listed in this Section must
21obtain the number of signatures specified in this Section on
22his or her petition for nomination.
23    (a) Statewide office or delegate to a national nominating
24convention. Except as otherwise provided in this Code, if a
25candidate seeks to run for statewide office or as a delegate or

1alternate delegate to a national nominating convention elected
2from the State at-large, then the candidate's petition for
3nomination must contain at least 5,000 but not more than
410,000 signatures.
5    (b) Congressional office or congressional delegate to a
6national nominating convention. Except as otherwise provided
7in this Code, if a candidate seeks to run for United States
8Congress or as a congressional delegate or alternate
9congressional delegate to a national nominating convention
10elected from a congressional district, then the candidate's
11petition for nomination must contain at least the number of
12signatures equal to 0.5% of the qualified primary electors of
13his or her party in his or her congressional district. In the
14first primary election following a redistricting of
15congressional districts, a candidate's petition for nomination
16must contain at least 600 signatures of qualified primary
17electors of the candidate's political party in his or her
18congressional district.
19    (c) County office. Except as otherwise provided in this
20Code, if a candidate seeks to run for any countywide office,
21including, but not limited to, county board chairperson or
22county board member, elected on an at-large basis, in a county
23other than Cook County, then the candidate's petition for
24nomination must contain at least the number of signatures
25equal to 0.5% of the qualified electors of his or her party who
26cast votes at the last preceding general election in his or her

1county. If a candidate seeks to run for county board member
2elected from a county board district, then the candidate's
3petition for nomination must contain at least the number of
4signatures equal to 0.5% of the qualified primary electors of
5his or her party in the county board district. In the first
6primary election following a redistricting of county board
7districts or the initial establishment of county board
8districts, a candidate's petition for nomination must contain
9at least the number of signatures equal to 0.5% of the
10qualified electors of his or her party in the entire county who
11cast votes at the last preceding general election divided by
12the total number of county board districts comprising the
13county board; provided that in no event shall the number of
14signatures be less than 25.
15    (d) County office; Cook County only.
16        (1) If a candidate seeks to run for countywide office
17    in Cook County, then the candidate's petition for
18    nomination must contain at least the number of signatures
19    equal to 0.5% of the qualified electors of his or her party
20    who cast votes at the last preceding general election in
21    Cook County.
22        (2) If a candidate seeks to run for Cook County Board
23    Commissioner, then the candidate's petition for nomination
24    must contain at least the number of signatures equal to
25    0.5% of the qualified primary electors of his or her party

1    election following a redistricting of Cook County Board of
2    Commissioners districts, a candidate's petition for
3    nomination must contain at least the number of signatures
4    equal to 0.5% of the qualified electors of his or her party
5    in the entire county who cast votes at the last preceding
6    general election divided by the total number of county
7    board districts comprising the county board; provided that
8    in no event shall the number of signatures be less than 25.
9        (3) Except as otherwise provided in this Code, if a
10    candidate seeks to run for Cook County Board of Review
11    Commissioner, which is elected from a district pursuant to
12    subsection (c) of Section 5-5 of the Property Tax Code,
13    then the candidate's petition for nomination must contain
14    at least the number of signatures equal to 0.5% of the
15    total number of registered voters in his or her board of
16    review district in the last general election at which a
17    commissioner was regularly scheduled to be elected from
18    that board of review district. In no event shall the
19    number of signatures required be greater than the
20    requisite number for a candidate who seeks countywide
21    office in Cook County under subsection (d)(1) of this
22    Section. In the first primary election following a
23    redistricting of Cook County Board of Review districts, a
24    candidate's petition for nomination must contain at least
25    4,000 signatures or at least the number of signatures
26    required for a countywide candidate in Cook County,

1    whichever is less, of the qualified electors of his or her
2    party in the district.
3    (e) Municipal or township office. If a candidate seeks to
4run for municipal or township office, then the candidate's
5petition for nomination must contain at least the number of
6signatures equal to 0.5% of the qualified primary electors of
7his or her party in the municipality or township. If a
8candidate seeks to run for alderperson of a municipality, then
9the candidate's petition for nomination must contain at least
10the number of signatures equal to 0.5% of the qualified
11primary electors of his or her party of the ward. In the first
12primary election following redistricting of wards or trustee
13districts of a municipality or the initial establishment of
14wards or districts, a candidate's petition for nomination must
15contain the number of signatures equal to at least 0.5% of the
16total number of votes cast for the candidate of that political
17party who received the highest number of votes in the entire
18municipality at the last regular election at which an officer
19was regularly scheduled to be elected from the entire
20municipality, divided by the number of wards or districts. In
21no event shall the number of signatures be less than 25.
22    (f) State central committeeperson. If a candidate seeks to
23run for State central committeeperson, then the candidate's
24petition for nomination must contain at least 100 signatures
25of the primary electors of his or her party of his or her
26congressional district.

1    (g) Sanitary district trustee. Except as otherwise
2provided in this Code, if a candidate seeks to run for trustee
3of a sanitary district in which trustees are not elected from
4wards, then the candidate's petition for nomination must
5contain at least the number of signatures equal to 0.5% of the
6primary electors of his or her party from the sanitary
7district. If a candidate seeks to run for trustee of a sanitary
8district in which trustees are elected from wards, then the
9candidate's petition for nomination must contain at least the
10number of signatures equal to 0.5% of the primary electors of
11his or her party in the ward of that sanitary district. In the
12first primary election following redistricting of sanitary
13districts elected from wards, a candidate's petition for
14nomination must contain at least the signatures of 150
15qualified primary electors of his or her ward of that sanitary
16district.
17    (h) Judicial office. Except as otherwise provided in this
18Code, if a candidate seeks to run for judicial office in a
19district, then the candidate's petition for nomination must
20contain the number of signatures equal to 0.4% of the number of
21votes cast in that district for the candidate for his or her
22political party for the office of Governor at the last general
23election at which a Governor was elected, but in no event less
24than 500 signatures. If a candidate seeks to run for judicial
25office in a circuit or subcircuit, then the candidate's
26petition for nomination must contain the number of signatures

1equal to 0.25% of the number of votes cast for the judicial
2candidate of his or her political party who received the
3highest number of votes at the last general election at which a
4judicial officer from the same circuit or subcircuit was
5regularly scheduled to be elected, but in no event less than
61,000 signatures in circuits and subcircuits located in the
7First Judicial District or 500 signatures in every other
8Judicial District.
9    (i) Precinct, ward, and township committeeperson. Except
10as otherwise provided in this Code, if a candidate seeks to run
11for precinct committeeperson, then the candidate's petition
12for nomination must contain at least 10 signatures of the
13primary electors of his or her party for the precinct. If a
14candidate seeks to run for ward committeeperson, then the
15candidate's petition for nomination must contain no less than
16the number of signatures equal to 10% of the primary electors
17of his or her party of the ward, but no more than 16% of those
18same electors; provided that the maximum number of signatures
19may be 50 more than the minimum number, whichever is greater.
20If a candidate seeks to run for township committeeperson, then
21the candidate's petition for nomination must contain no less
22than the number of signatures equal to 5% of the primary
23electors of his or her party of the township, but no more than
248% of those same electors; provided that the maximum number of
25signatures may be 50 more than the minimum number, whichever
26is greater.

1    (j) State's attorney or regional superintendent of schools
2for multiple counties. If a candidate seeks to run for State's
3attorney or regional Superintendent of Schools who serves more
4than one county, then the candidate's petition for nomination
5must contain at least the number of signatures equal to 0.5% of
6the primary electors of his or her party in the territory
7comprising the counties.
8    (k) Any other office. If a candidate seeks any other
9office, then the candidate's petition for nomination must
10contain at least the number of signatures equal to 0.5% of the
11registered voters of the political subdivision, district, or
12division for which the nomination is made or 25 signatures,
13whichever is greater.
14    For purposes of this Section the number of primary
15electors shall be determined by taking the total vote cast, in
16the applicable district, for the candidate for that political
17party who received the highest number of votes, statewide, at
18the last general election in the State at which electors for
19President of the United States were elected. For political
20subdivisions, the number of primary electors shall be
21determined by taking the total vote cast for the candidate for
22that political party who received the highest number of votes
23in the political subdivision at the last regular election at
24which an officer was regularly scheduled to be elected from
25that subdivision. For wards or districts of political
26subdivisions, the number of primary electors shall be

1determined by taking the total vote cast for the candidate for
2that political party who received the highest number of votes
3in the ward or district at the last regular election at which
4an officer was regularly scheduled to be elected from that
5ward or district.
6    A "qualified primary elector" of a party may not sign
7petitions for or be a candidate in the primary of more than one
8party.
9    The changes made to this Section by Public Act 93-574 are
10declarative of existing law, except for item (3) of subsection
11(d).
12    Petitions of candidates for nomination for offices herein
13specified, to be filed with the same officer, may contain the
14names of 2 or more candidates of the same political party for
15the same or different offices. In the case of the offices of
16Governor and Lieutenant Governor, a joint petition including
17one candidate for each of those offices must be filed.

1certify that the signatures on the sheet were signed during
2the period of January 13, 2022 through the date on which this
3statement was sworn or affirmed to. No petition sheet shall be
4circulated more than 90 days preceding the last day provided
5in Section 8-9 for the filing of such petition.

7of Elections shall be the original sheets which have been

24for nomination under this Article 10 for candidates for public

1provided by law, be as follows: Such petitions shall consist
2of sheets of uniform size and each sheet shall contain, above
3the space for signature, an appropriate heading, giving the
4information as to name of candidate or candidates in whose
5behalf such petition is signed; the office; the party; place
6of residence; and such other information or wording as
7required to make same valid, and the heading of each sheet
8shall be the same. Such petition shall be signed by the
9qualified voters in their own proper persons only, and
10opposite the signature of each signer his residence address
11shall be written or printed. The residence address required to
12be written or printed opposite each qualified primary
13elector's name shall include the street address or rural route
14number of the signer, as the case may be, as well as the
15signer's county, and city, village or town, and state.
16However, the county or city, village or town, and state of
17residence of such electors may be printed on the petition
18forms where all of the electors signing the petition reside in
19the same county or city, village or town, and state. Standard
20abbreviations may be used in writing the residence address,
21including street number, if any. Except as otherwise provided
22in this Code, no signature shall be valid or be counted in
23considering the validity or sufficiency of such petition
24unless the requirements of this Section are complied with. At
25the bottom of each sheet of such petition shall be added a
26circulator's statement, signed by a person 16 18 years of age

1or older who is a citizen of the United States; stating the
2street address or rural route number, as the case may be, as
3well as the county, city, village or town, and state;
4certifying that the signatures on that sheet of the petition
5were signed in his or her presence; certifying that the
6signatures are genuine; and either (1) indicating the dates on
7which that sheet was circulated, or (2) indicating the first
8and last dates on which the sheet was circulated, or (3)
9certifying that none of the signatures on the sheet were
10signed more than 90 days preceding the last day for the filing
11of the petition; and certifying that to the best of his
12knowledge and belief the persons so signing were at the time of
13signing the petition duly registered voters under Article 4,
145, or 6 of this Code of the political subdivision or district
15for which the candidate or candidates shall be nominated, and
16certifying that their respective residences are correctly
17stated therein. Such statement shall be sworn to before some
18officer authorized to administer oaths in this State. Except
19as otherwise provided in this Code, no petition sheet shall be
20circulated more than 90 days preceding the last day provided
21in Section 10-6 for the filing of such petition. Such sheets,
22before being presented to the electoral board or filed with
23the proper officer of the electoral district or division of
24the state or municipality, as the case may be, shall be neatly
25fastened together in book form, by placing the sheets in a pile
26and fastening them together at one edge in a secure and

1suitable manner, and the sheets shall then be numbered
2consecutively. The sheets shall not be fastened by pasting
3them together end to end, so as to form a continuous strip or
4roll. All petition sheets which are filed with the proper
5local election officials, election authorities or the State
6Board of Elections shall be the original sheets which have
7been signed by the voters and by the circulator, and not
8photocopies or duplicates of such sheets. A petition, when
9presented or filed, shall not be withdrawn, altered, or added
10to, and no signature shall be revoked except by revocation in
11writing presented or filed with the officers or officer with
12whom the petition is required to be presented or filed, and
13before the presentment or filing of such petition. Whoever
14forges any name of a signer upon any petition shall be deemed
15guilty of a forgery, and on conviction thereof, shall be
16punished accordingly. The word "petition" or "petition for
17nomination", as used herein, shall mean what is sometimes
18known as nomination papers, in distinction to what is known as
19a certificate of nomination. The words "political division for
20which the candidate is nominated", or its equivalent, shall
21mean the largest political division in which all qualified
22voters may vote upon such candidate or candidates, as the
23state in the case of state officers; the township in the case
24of township officers et cetera. Provided, further, that no
25person shall circulate or certify petitions for candidates of
26more than one political party, or for an independent candidate

2upon at the next primary or general election, or for such
3candidates and parties with respect to the same political
4subdivision at the next consolidated election.

7    Sec. 17-9. Any person desiring to vote shall give his name
8and, if required to do so, his residence to the judges of
9election, one of whom shall thereupon announce the same in a
10loud and distinct tone of voice, clear, and audible; the
11judges of elections shall check each application for ballot
12against the list of voters registered in that precinct to whom
13grace period, vote by mail, or early ballots have been issued
14for that election, which shall be provided by the election
15authority and which list shall be available for inspection by
16pollwatchers. A voter applying to vote in the precinct on
17election day whose name appears on the list as having been
18issued a grace period, vote by mail, or early ballot shall not
19be permitted to vote in the precinct, except that a voter to
20whom a vote by mail ballot was issued may vote in the precinct
21if the voter submits to the election judges that vote by mail
22ballot for cancellation. If the voter is unable to submit the
23vote by mail ballot, it shall be sufficient for the voter to
24submit to the election judges (i) a portion of the vote by mail
25ballot if the vote by mail ballot was torn or mutilated or (ii)

1an affidavit executed before the election judges specifying
2that (A) the voter never received a vote by mail ballot or (B)
3the voter completed and returned a vote by mail ballot and was
4informed that the election authority did not receive that vote
5by mail ballot. All applicable provisions of Articles 4, 5 or 6
6shall be complied with and if such name is found on the
7register of voters by the officer having charge thereof, he
8shall likewise repeat said name, and the voter shall be
9allowed to enter within the proximity of the voting booths, as
10above provided. One of the judges shall give the voter one, and
11only one of each ballot to be voted at the election, on the
12back of which ballots such judge shall indorse his initials in
13such manner that they may be seen when each such ballot is
14properly folded, and the voter's name shall be immediately
15checked on the register list. In those election jurisdictions
16where perforated ballot cards are utilized of the type on
17which write-in votes can be cast above the perforation, the
18election authority shall provide a space both above and below
19the perforation for the judge's initials, and the judge shall
20endorse his or her initials in both spaces. Whenever a
21proposal for a constitutional amendment or for the calling of
22a constitutional convention is to be voted upon at the
23election, the separate blue ballot or ballots pertaining
24thereto shall, when being handed to the voter, be placed on top
25of the other ballots to be voted at the election in such manner
26that the legend appearing on the back thereof, as prescribed

1in Section 16-6 of this Act, shall be plainly visible to the
2voter. At all elections, when a registry may be required, if
3the name of any person so desiring to vote at such election is
4not found on the register of voters, he or she shall not
5receive a ballot until he or she shall have complied with the
6law prescribing the manner and conditions of voting by
7unregistered voters. If any person desiring to vote at any
8election shall be challenged, he or she shall not receive a
9ballot until he or she shall have established his right to vote
10in the manner provided hereinafter; and if he or she shall be
11challenged after he has received his ballot, he shall not be
12permitted to vote until he or she has fully complied with such
13requirements of the law upon being challenged. Besides the
14election officer, not more than 2 voters in excess of the whole
15number of voting booths provided shall be allowed within the
16proximity of the voting booths at one time. The provisions of
17this Act, so far as they require the registration of voters as
18a condition to their being allowed to vote shall not apply to
19persons otherwise entitled to vote, who are, at the time of the
20election, or at any time within 60 days prior to such election
21have been engaged in the military or naval service of the
22United States, and who appear personally at the polling place
23on election day and produce to the judges of election
24satisfactory evidence thereof, but such persons, if otherwise
25qualified to vote, shall be permitted to vote at such election

2circumstances:
3        (1) The person's name does not appear on the official
4    list of eligible voters for the precinct in which the
5    person seeks to vote and the person has refused an
6    opportunity to register at the polling location or another
7    grace period registration site. The official list is the
8    centralized statewide voter registration list established
9    and maintained in accordance with Section 1A-25;
10        (2) The person's voting status has been challenged by
11    an election judge, a pollwatcher, or any legal voter and
12    that challenge has been sustained by a majority of the
13    election judges;
14        (3) A federal or State court order extends the time
15    for closing the polls beyond the time period established
16    by State law and the person votes during the extended time
17    period;
18        (4) The voter registered to vote by mail and is
19    required by law to present identification when voting
20    either in person or by early voting ballot, but fails to do
21    so;
22        (5) The voter's name appears on the list of voters who
23    voted during the early voting period, but the voter claims
24    not to have voted during the early voting period;
25        (6) The voter received a vote by mail ballot but did
26    not return the vote by mail ballot to the election

1    authority; or
2        (7) The voter attempted to register to vote on
3    election day, but failed to provide the necessary
4    documentation.
5    (b) The procedure for obtaining and casting a provisional
6ballot at the polling place shall be as follows:
7        (1) After first verifying through an examination of
8    the precinct register that the person's address is within
9    the precinct boundaries, an election judge at the polling
10    place shall notify a person who is entitled to cast a
11    provisional ballot pursuant to subsection (a) that he or
12    she may cast a provisional ballot in that election. An
13    election judge must accept any information provided by a
14    person who casts a provisional ballot that the person
15    believes supports his or her claim that he or she is a duly
16    registered voter and qualified to vote in the election.
17    However, if the person's residence address is outside the
18    precinct boundaries, the election judge shall inform the
19    person of that fact, give the person the appropriate
20    telephone number of the election authority in order to
21    locate the polling place assigned to serve that address,
22    and instruct the person to go to the proper polling place
23    to vote.
24        (2) The person shall execute a written form provided
25    by the election judge that shall state or contain all of
26    the following that is available:

1        The written affidavit form described in this
2    subsection (b)(2) must be printed on a multi-part form
3    prescribed by the county clerk or board of election
4    commissioners, as the case may be.
5        (3) After the person executes the portion of the
6    written affidavit described in subsection (b)(2)(i) of
7    this Section, the election judge shall complete the
8    portion of the written affidavit described in subsection
9    (b)(2)(iii) and (b)(2)(iv).
10        (4) The election judge shall give a copy of the
11    completed written affidavit to the person. The election
12    judge shall place the original written affidavit in a
13    self-adhesive clear plastic packing list envelope that
14    must be attached to a separate envelope marked as a
15    "provisional ballot envelope". The election judge shall
16    also place any information provided by the person who
17    casts a provisional ballot in the clear plastic packing
18    list envelope. Each county clerk or board of election
19    commissioners, as the case may be, must design, obtain or
20    procure self-adhesive clear plastic packing list envelopes
21    and provisional ballot envelopes that are suitable for
22    implementing this subsection (b)(4) of this Section.
23        (5) The election judge shall provide the person with a
24    provisional ballot, written instructions for casting a
25    provisional ballot, and the provisional ballot envelope
26    with the clear plastic packing list envelope affixed to

1    it, which contains the person's original written affidavit
2    and, if any, information provided by the provisional voter
3    to support his or her claim that he or she is a duly
4    registered voter. An election judge must also give the
5    person written information that states that any person who
6    casts a provisional ballot shall be able to ascertain,
7    pursuant to guidelines established by the State Board of
8    Elections, whether the provisional vote was counted in the
9    official canvass of votes for that election and, if the
10    provisional vote was not counted, the reason that the vote
11    was not counted.
12        (6) After the person has completed marking his or her
13    provisional ballot, he or she shall place the marked
14    ballot inside of the provisional ballot envelope, close
15    and seal the envelope, and return the envelope to an
16    election judge, who shall then deposit the sealed
17    provisional ballot envelope into a securable container
18    separately identified and utilized for containing sealed
19    provisional ballot envelopes. Ballots that are provisional
20    because they are cast after 7:00 p.m. by court order shall
21    be kept separate from other provisional ballots. Upon the
22    closing of the polls, the securable container shall be
23    sealed with filament tape provided for that purpose, which
24    shall be wrapped around the box lengthwise and crosswise,
25    at least twice each way, and each of the election judges
26    shall sign the seal.

1    (c) Instead of the affidavit form described in subsection
2(b), the county clerk or board of election commissioners, as
3the case may be, may design and use a multi-part affidavit form
4that is imprinted upon or attached to the provisional ballot
5envelope described in subsection (b). If a county clerk or
6board of election commissioners elects to design and use its
7own multi-part affidavit form, then the county clerk or board
8of election commissioners shall establish a mechanism for
9accepting any information the provisional voter has supplied
10to the election judge to support his or her claim that he or
11she is a duly registered voter. In all other respects, a county
12clerk or board of election commissioners shall establish
13procedures consistent with subsection (b).
14    (d) The county clerk or board of election commissioners,
15as the case may be, shall use the completed affidavit form
16described in subsection (b) to update the person's voter
17registration information in the State voter registration
18database and voter registration database of the county clerk
19or board of election commissioners, as the case may be. If a
20person is later determined not to be a registered voter based
21on Section 18A-15 of this Code, then the affidavit shall be
22processed by the county clerk or board of election
23commissioners, as the case may be, as a voter registration
24application.

4mail ballot which shall be considered a method of application
5in lieu of the official postcard.
6    1. Members of the United States Service and citizens of
7the United States temporarily residing outside the territorial
8limits of the United States may make application within the
9periods prescribed in Sections 20-2 or 20-2.1, as the case may
10be. Such application shall be substantially in the following
11form:

13    Sec. 28-3. Form of petition for public question. Petitions
14for the submission of public questions shall consist of sheets
15of uniform size and each sheet shall contain, above the space
16for signature, an appropriate heading, giving the information
17as to the question of public policy to be submitted, and
18specifying the state at large or the political subdivision or
19district or precinct or combination of precincts or other
20territory in which it is to be submitted and, where by law the
21public question must be submitted at a particular election,
22the election at which it is to be submitted. In the case of a
23petition for the submission of a public question described in
24subsection (b) of Section 28-6, the heading shall also specify
25the regular election at which the question is to be submitted

1and include the precincts included in the territory concerning
2which the public question is to be submitted, as well as a
3common description of such territory in plain and nonlegal
4language, such description to describe the territory by
5reference to streets, natural or artificial landmarks,
6addresses or any other method which would enable a voter
7signing the petition to be informed of the territory
8concerning which the question is to be submitted. The heading
9of each sheet shall be the same. Such petition shall be signed
10by the registered voters of the political subdivision or
11district or precinct or combination of precincts in which the
12question of public policy is to be submitted in their own
13proper persons only, and opposite the signature of each signer
14his residence address shall be written or printed, which
15residence address shall include the street address or rural
16route number of the signer, as the case may be, as well as the
17signer's county, and city, village or town, and state;
18provided that the county or city, village or town, and state of
19residence of such electors may be printed on the petition
20forms where all of the electors signing the petition reside in
21the same county or city, village or town, and state. Standard
22abbreviations may be used in writing the residence address,
23including street number, if any. No signature shall be valid
24or be counted in considering the validity or sufficiency of
25such petition unless the requirements of this Section are
26complied with.

1    At the bottom of each sheet of such petition shall be added
2a circulator's statement, signed by a person 16 18 years of age
3or older who is a citizen of the United States, stating the
4street address or rural route number, as the case may be, as
5well as the county, city, village or town, and state;
6certifying that the signatures on that sheet of the petition
7were signed in his or her presence and are genuine, and that to
8the best of his or her knowledge and belief the persons so
9signing were at the time of signing the petition registered
10voters of the political subdivision or district or precinct or
11combination of precincts in which the question of public
12policy is to be submitted and that their respective residences
13are correctly stated therein. Such statement shall be sworn to
14before some officer authorized to administer oaths in this
15State.
16    Such sheets, before being filed with the proper officer or
17board shall be bound securely and numbered consecutively. The
18sheets shall not be fastened by pasting them together end to
19end, so as to form a continuous strip or roll. All petition
20sheets which are filed with the proper local election
21officials, election authorities or the State Board of
22Elections shall be the original sheets which have been signed
23by the voters and by the circulator, and not photocopies or
24duplicates of such sheets. A petition, when presented or
25filed, shall not be withdrawn, altered, or added to, and no
26signature shall be revoked except by revocation in writing

1presented or filed with the board or officer with whom the
2petition is required to be presented or filed, and before the
3presentment or filing of such petition, except as may
4otherwise be provided in another statute which authorize the
5public question. Whoever forges any name of a signer upon any
6petition shall be deemed guilty of a forgery, and on
7conviction thereof, shall be punished accordingly.
8    In addition to the foregoing requirements, a petition
9proposing an amendment to Article IV of the Constitution
10pursuant to Section 3 of Article XIV of the Constitution or a
11petition proposing a question of public policy to be submitted
12to the voters of the entire State shall be in conformity with
13the requirements of Section 28-9 of this Article.
14    If multiple sets of petitions for submission of the same
15public questions are filed, the State Board of Elections,
16appropriate election authority or local election official
17where the petitions are filed shall within 2 business days
18notify the proponent of his or her multiple petition filings
19and that proponent has 3 business days after receipt of the
20notice to notify the State Board of Elections, appropriate
21election authority or local election official that he or she
22may cancel prior sets of petitions. If the proponent notifies
23the State Board of Elections, appropriate election authority
24or local election official, the last set of petitions filed
25shall be the only petitions to be considered valid by the State
26Board of Elections, appropriate election authority or local
