2023 and 2024 HB4158 Introduced , by Rep. John M. Cabello SYNOPSIS AS INTRODUCED: | | | Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to establish and administer a Seniors Deserve Dignity Program that provides monthly supplemental personal needs payments to persons residing in supportive living facilities who receive medical assistance and a personal needs allowance as specified in the Illinois Administrative Code. Provides that, beginning July 1, 2024, a qualifying person shall receive a monthly supplemental personal needs payment in the amount of $30 so that the person's total monthly personal needs allowance is no less than $120. Provides that, beginning July 1, 2025, a qualifying person shall receive a monthly supplemental personal needs payment in the amount of $60 so that the person's total monthly personal needs allowance is no less than $150. Requires a qualifying person's monthly supplemental personal needs payment amount to be adjusted for inflation beginning July 1, 2026 and every July 1 thereafter. Provides that the monthly supplemental personal needs payments shall not be considered income for purposes of determining eligibility or the amount of assistance for any public aid benefit provided under State law. Grants the Department rulemaking authority. Effective July 1, 2024. |

| 1 | | AN ACT concerning public aid. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 5. The Illinois Public Aid Code is amended by | 5 | | adding Section 5-5.01c as follows: | 6 | | (305 ILCS 5/5-5.01c new) | 7 | | Sec. 5-5.01c. Seniors Deserve Dignity Program; | 8 | | supplemental personal needs payments. Subject to | 9 | | appropriation, the Department shall establish and administer a | 10 | | Seniors Deserve Dignity Program that provides monthly | 11 | | supplemental personal needs payments to persons residing in | 12 | | supportive living facilities authorized under Section 5-5.01a | 13 | | who receive medical assistance under this Article and a | 14 | | personal needs allowance as specified in 89 Ill. Adm. Code | 15 | | 146.225(c). Beginning July 1, 2024 through June 30, 2025, a | 16 | | qualifying person shall receive a monthly supplemental | 17 | | personal needs payment in the amount of $30 so that the | 18 | | person's total monthly personal needs allowance is no less | 19 | | than $120. The Department may adopt any rules | 9 | | necessary to implement the program. | 10 | | As used in this Section, "Consumer Price Index-U" means | 11 | | the index published by the Bureau of Labor Statistics of the | 12 | | United States Department of Labor that measures the average | 13 | | change in prices of goods and services purchased by all urban | 14 | | consumers, United States city average, all items, 1982-84 = | 15 | | 100. | 16 | | Section 99. Effective date. This Act takes effect July 1, | 17 | | 2024. |
