1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Cemetery Oversight Act is amended by
5changing Section 20-10 as follows:
 
6    (225 ILCS 411/20-10)
7    (Section scheduled to be repealed on January 1, 2027)
8    Sec. 20-10. Contract.
9    (a) At the time cemetery arrangements are made and prior
10to rendering the cemetery services, a cemetery authority shall
11create a completed written contract to be provided to the
12consumer, signed by both parties by their actual written
13signatures on either paper or electronic form, that shall
14contain: (i) the date on which the arrangements were made;
15(ii) the price of the service selected and the services and
16merchandise included for that price; (iii) the supplemental
17items of service and merchandise requested and the price of
18each item; (iv) the terms or method of payment agreed upon; and
19(v) a statement as to any monetary advances made on behalf of
20the family. The cemetery authority shall maintain a copy of
21such written contract in its permanent records.
22    (b) Any retail installment contract for the purchase of
23interment, entombment, or inurnment rights shall contain a

1clearly worded notice in 12-point type, bold, underlined, and
2capital letters, that rights to a deeded interest do not vest
3until final payment and that upon an uncured default,
4including when a contract is rolled into a new open-balance
5retail installment contract, with additional interment,
6entombment, or inurnment rights or additional cemetery
7merchandise or services, there will be no deeded interest.
