SYNOPSIS AS INTRODUCED:
 
20 ILCS 2310/2310-475 new

    Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health shall ensure that any physician licensed to practice medicine in all its branches or health care provider who sees or treats children 6 years of age or younger shall assess those children for their access to unsecured firearms when those children reside in a home that has firearms. Provides that children residing in a home that does not contain firearms shall be evaluated for risk by the Childhood Firearm Access Risk Questionnaire developed by the Department and assessed if indicated. Provides that children shall be evaluated in accordance with rules adopted by the Department. Makes other changes. Effective January 1, 2024.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-475 as follows:
 
7    (20 ILCS 2310/2310-475 new)
8    Sec. 2310-475. Safe gun storage; pediatricians;
9dissemination by the Department.
10    (a) The Department shall ensure that any physician
11licensed to practice medicine in all its branches or health
12care provider who sees or treats children 6 years of age or
13younger shall assess those children for their access to
14unsecured firearms when those children reside in a home that
15has firearms. Children residing in a home that does not
16contain firearms shall be evaluated for risk by the Childhood
17Firearm Access Risk Questionnaire developed by the Department
18and assessed if indicated. Children shall be evaluated in
19accordance with rules adopted by the Department.
20    (b) The Department shall ensure that each licensed,
21registered, or approved health care facility serving children
226 years of age or younger, including, but not limited to,
23health departments, hospitals, clinics, and health maintenance

1organizations approved, registered, or licensed by the
2Department, shall take the appropriate steps to ensure that
3children 6 years of age or younger be evaluated for risk of
4access to unsecured firearms.
5    (c) The Department shall adopt rules to assess whether
6children 7 years and older and pregnant persons may also be
7evaluated for risk of access to unsecured firearms by
8physicians or health care providers. The Department shall also
9ensure that physicians and health care providers shall
10evaluate children for access to unsecured firearms with the
11school health examination, as required under the School Code,
12when, in the medical judgment of the physician, advanced
13practice registered nurse, or physician assistant, the child
14is potentially at high risk of access to firearms.
 
15    Section 99. Effective date. This Act takes effect January
161, 2024.
