SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/26-7

    Amends the Criminal Code of 2012. Provides that a person commits disorderly conduct with a laser or laser pointer when he or she intentionally or knowingly aims a laser or laser pointer at a person or at a person's residence without the consent of that person. provides that a violation is a Class A misdemeanor.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by
5changing Section 26-7 as follows:
 
6    (720 ILCS 5/26-7)
7    Sec. 26-7. Disorderly conduct with a laser or laser
8pointer.
9    (a) Definitions. For the purposes of this Section:
10        "Aircraft" means any contrivance now known or
11    hereafter invented, used, or designed for navigation of or
12    flight in the air, but excluding parachutes.
13        "Laser" means both of the following:
14            (1) any device that utilizes the natural
15        oscillations of atoms or molecules between energy
16        levels for generating coherent electromagnetic
17        radiation in the ultraviolet, visible, or infrared
18        region of the spectrum and when discharged exceeds one
19        milliwatt continuous wave;
20            (2) any device designed or used to amplify
21        electromagnetic radiation by simulated emission that
22        is visible to the human eye.
23        "Laser pointer" means a hand-held device that emits

1    light amplified by the stimulated emission of radiation
2    that is visible to the human eye.
3        "Laser sight" means a laser pointer that can be
4    attached to a firearm and can be used to improve the
5    accuracy of the firearm.
6    (b) A person commits disorderly conduct with a laser or
7laser pointer when he or she intentionally or knowingly:
8        (1) aims an operating laser pointer at a person he or
9    she knows or reasonably should know to be a peace officer;
10    or
11        (2) aims and discharges a laser or other device that
12    creates visible light into the cockpit of an aircraft that
13    is in the process of taking off, landing, or is in flight;
14    or
15        (3) aims a laser or laser pointer at a person or at a
16    person's residence without the consent of that person.
17    (c) Paragraph (2) of subsection (b) does not apply to the
18following individuals who aim and discharge a laser or other
19device at an aircraft:
20        (1) an authorized individual in the conduct of
21    research and development or flight test operations
22    conducted by an aircraft manufacturer, the Federal
23    Aviation Administration, or any other person authorized by
24    the Federal Aviation Administration to conduct this
25    research and development or flight test operations; or
26        (2) members or elements of the Department of Defense

1    or Department of Homeland Security acting in an official
2    capacity for the purpose of research, development,
3    operations, testing, or training.
4    (d) Sentence. Disorderly conduct with a laser or laser
5pointer is a Class A misdemeanor.
