    Amends the Department of Agriculture Law of the Civil Administrative Code of Illinois. Provides that the Department of Agriculture shall award grants to special access food providers in the State.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Agriculture Law of the Civil
5Administrative Code of Illinois is amended by adding Section
6205-455 as follows:
 
7    (20 ILCS 205/205-455 new)
8    Sec. 205-455. Grants to special access food providers.
9    (a) Beginning on July 1, 2023, subject to appropriation,
10the Department shall award grants to special access food
11providers in the State. The amount of the grant may not exceed
12the sum or 15% of the special access food provider's basis in
13the grocery store, plus 10% of the renovation expenditures
14incurred by the special access food provider.
15    (b) As used in this Section:
16    "Food desert" means any census tract that meets the
17following criteria:
18        (1) if the census tract is located in a metropolitan
19    area, then not less than 500 people or 33% of the
20    population of the census tract, whichever is less, reside
21    more than one mile from a grocery store; or
22        (2) if the census tract is located in a
23    nonmetropolitan area, then not less than 500 people or 33%

1    of the population of the census tract, whichever is less,
2    reside more than 10 miles from a grocery store.
3    "Grocery store" means a retail store for which forecasted
4sales of groceries account for not less than 35% of its total
5annual sales.
6    "Person" means any individual, partnership, corporation,
7association, or other organization.
8    "Special access food provider" means a person that is
9seeking to construct, renovate, or rehabilitate a property
10that (i) will be used as a grocery store upon completion of the
11construction, renovation, or rehabilitation and (ii) is
12located in a food desert in the State on the date on which
13construction, renovation, or rehabilitation begins.
