1    AN ACT concerning wildlife.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Recreational Trails of Illinois Act is
5amended by changing Section 25.5 as follows:
 
6    (20 ILCS 862/25.5)
7    Sec. 25.5. Off-highway vehicle trails public access
8sticker.
9    (a) An off-highway vehicle trails public access sticker is
10a separate and additional requirement from the Off-Highway
11Vehicle Usage Stamp under Section 26 of this Act.
12    (b) Except as provided in subsection (c) of this Section,
13a person may not operate and an owner may not give permission
14to another to operate an off-highway vehicle on lands or
15waters in public off-highway vehicle parks paid for, operated,
16or supported by the grant program established under subsection
17(d) of Section 15 of this Act unless the off-highway vehicle
18displays an off-highway vehicle trails public access sticker
19in a manner prescribed by the Department by rule.
20    (c) An off-highway vehicle does not need an off-highway
21vehicle trails public access sticker if the off-highway
22vehicle is used on private land or if the off-highway vehicle
23is owned by the State, the federal government, or a unit of

1local government.
2    (d) The Department shall issue an off-highway vehicle
3trails public access sticker and shall charge the following
4fees:
5        (1) $30 for 3 years for individuals;
6        (2) $50 for 3 years for rental units;
7        (3) $75 for 3 years for dealer and manufacturer
8    demonstrations and research;
9        (4) $50 for 3 years for an all-terrain vehicle or
10    off-highway motorcycle used for production agriculture, as
11    defined in Section 3-821 of the Illinois Vehicle Code;
12        (5) $50 for 3 years for residents of a State other than
13    Illinois that does not have a reciprocal agreement with
14    the Department, under subsection (e) of this Section; and
15        (6) $50 for 3 years for an all-terrain vehicle or
16    off-highway motorcycle that does not have a title.
17    (d-5) The Department, by administrative rule, may make
18replacement stickers available at a reduced cost. The fees for
19public access stickers shall be deposited as follows: into the
20Off-Highway Vehicle Trails Fund
21        (1) $5 from the sale of each off-highway vehicle
22    trails public access sticker shall be deposited into the
23    Tick Research, Education, and Evaluation (TREE) Fund,
24    which is created as a special fund in the State treasury.
25    Moneys deposited in the Tick Research, Education, and
26    Evaluation (TREE) Fund shall be paid as grants for the

1    ordinary and contingent expenses associated with tick
2    research, education, and evaluation; and
3        (2) the remainder of the fees for public access
4    stickers shall be deposited into the Off-Highway Vehicle
5    Trails Fund to be used for improvements to Illinois State
6    Parks.
7    (e) The Department may enter into reciprocal agreements
8with other states that have a similar off-highway vehicle
9trails public access sticker program to allow residents of
10those states to operate off-highway vehicles on land or lands
11or waters in public off-highway vehicle parks paid for,
12operated, or supported by the off-highway vehicle trails grant
13program established under subsection (d) of Section 15 of this
14Act without acquiring an off-highway vehicle trails public
15access sticker in this State under subsection (b) of this
16Section.
17    (f) The Department may license vendors to sell off-highway
18vehicle trails public access stickers. Issuing fees may be set
19by administrative rule.
20    (g) Any person participating in an organized competitive
21event on land or lands in off-highway vehicle parks paid for,
22operated by, or supported by the grant program established in
23subsection (d) of Section 15 shall display the public access
24sticker required under subsection (b) of this Section or pay
25$5 per event. Fees collected under this subsection shall be
26deposited into the Off-Highway Vehicle Trails Fund.

2    Section 10. The State Finance Act is amended by adding
3Section 5.990 as follows:
 
4    (30 ILCS 105/5.990 new)
5    Sec. 5.990. The Tick Research, Education, and Evaluation
6(TREE) Fund.
