SYNOPSIS AS INTRODUCED:
 
30 ILCS 500/50-36.5 new

    Amends the Illinois Procurement Code. Defines "company" and "foreign terrorist organization". Provides that, notwithstanding any provision of law to the contrary, any company that knowingly provides material support or resources to a foreign terrorist organization or attempts or conspires to do so shall be prohibited from contracting with any unit of State or local government, subcontracting under such a contract, or furnishing materials under such a contract or subcontract. Provides that the Executive Ethics Commission may adopt rules necessary to implement this prohibition.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Procurement Code is amended by
5adding Section 50-36.5 as follows:
 
6    (30 ILCS 500/50-36.5 new)
7    Sec. 50-36.5. Prohibited companies.
8    (a) As used in this Section:
9    "Company" means any for-profit sole proprietorship,
10organization, association, corporation, partnership, joint
11venture, limited partnership, limited liability partnership,
12limited liability company, or other entity or business
13association, including all wholly owned subsidiaries,
14majority-owned subsidiaries, parent companies, or affiliates
15of those entities or business associations, and their owners,
16officers, directors, partners, managers, and agents (hereafter
17"responsible officers"), and any firm, corporation,
18partnership, or association in which such company or
19responsible officers own, control, or have more than a nominal
20ownership interest.
21    "Foreign terrorist organization" means an organization
22that has been designated as a foreign terrorist organization
23under Section 219 of the Immigration and Nationality Act (8

1U.S.C. 1189) as of the date on which the material support,
2resources, attempt, or conspiracy occurred.
3    (b) Notwithstanding any provision of law to the contrary,
4any company that knowingly provides material support or
5resources to a foreign terrorist organization, or attempts or
6conspires to do so as defined by 18 U.S.C. 2339B, shall be
7prohibited from contracting with any unit of State or local
8government, subcontracting under such a contract, or
9furnishing of materials under a contract or subcontract, as a
10result of a conviction under 18 U.S.C. 2339A or 2339B or a
11finding by the Executive Ethics Commission.
12    (c) The Executive Ethics Commission may adopt rules
13necessary to implement and administer the provisions of this
14Section.
