1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Justice40 Oversight Committee Act.
 
6    Section 5. Purpose; findings.
7    (a) The purpose of this Act is to further the interest of
8the State of Illinois in Justice40, an initiative to deliver
9at least 40% of the overall benefits from federal investments
10in climate and clean energy to disadvantaged communities.
11    (b) The General Assembly finds that disadvantaged
12communities bear a disproportionate burden from the effects of
13climate change. The State of Illinois has a responsibility to
14protect these communities and to enable the use of these
15resources and must adequately prepare to make robust policy
16suggestions in consultation with residents from disadvantaged
17communities, advocates, and industries.
 
18    Section 10. Definition. In this Act, "Oversight Committee"
19means the Justice40 Oversight Committee established under
20Section 15.
 
21    Section 15. Justice40 Oversight Committee; duties.

1    (a) The Justice40 Oversight Committee is established. The
2Oversight Committee shall:
3        (1) make findings, conclusions, and recommendations
4    regarding environmental justice in this State and uses of
5    federal funds provided to the State for environmental
6    justice;
7        (2) submit an initial report delineating the Oversight
8    Committee's findings, conclusions, and recommendations to
9    the General Assembly no later than June 30, 2024; and
10        (3) after the initial report under paragraph (2),
11    submit an annual report delineating the Oversight
12    Committee's findings, conclusions, and recommendations to
13    the General Assembly no later than June 30 of each year
14    after 2023.
15    (b) After initial voting members have been appointed under
16Section 20, the Oversight Committee shall meet not less than
17twice each quarter after the effective date of this Act to
18carry out its duties under this Act.
 
19    Section 20. Appointments; members.
20    (a) Members of the Oversight Committee shall be appointed
21according to subsections (d) and (e) no later than 60 days
22after the effective date of this Act. If a vacancy occurs
23within the Oversight Committee, the vacancy shall be filled in
24a manner consistent with subsections (d) and (e).
25    (b) At the discretion of both of the Co-Chairpersons,

1additional individuals may participate as nonvoting members of
2the Oversight Committee.
3    (c) With the approval of both of the Co-Chairpersons,
4additional individuals may be appointed as voting members of
5the Oversight Committee.
6    (d) The Oversight Committee shall consist of the following
7voting members:
8        (1) four members appointed as follows and who
9    represent, when possible, disadvantaged communities:
10            (A) one member appointed by the Speaker of the
11        House of Representatives, who shall serve as
12        Co-Chairperson;
13            (B) one member appointed by the President of the
14        Senate, who shall serve as Co-Chairperson;
15            (C) one member appointed by the Minority Leader of
16        the Senate;
17            (D) one member appointed by the Minority Leader of
18        the House of Representatives;
19        (2) the Director of the Illinois Environmental
20    Protection Agency or his or her designee;
21        (3) the Director of Public Health or his or her
22    designee;
23        (4) the Secretary of Human Services or his or her
24    designee; and
25        (5) the Secretary of Transportation or his or her
26    designee.

1    (e) The Oversight Committee may, at the discretion of the
2Oversight Committee, consist of the following nonvoting
3members:
4        (1) two representatives from labor organizations;
5        (2) two representatives from a statewide organization
6    representing manufacturers;
7        (3) two representatives from faith-based
8    organizations;
9        (4) two representatives from environmental justice
10    organizations;
11        (5) two representatives from community-based
12    organizations that work to facilitate affordable housing,
13    transportation, or other essential services;
14        (6) two residents of disadvantaged communities; and
15        (7) a person nominated by a federal agency.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.
