SYNOPSIS AS INTRODUCED:

    Amends the Illinois Lottery Law. Creates a special instant scratch-off game for the benefit of the Juvenile Diabetes Research Foundation, Illinois Chapter, type 1 diabetes research, support, education, and awareness. Provides that the net revenue from the scratch-off game shall be deposited into the Juvenile Diabetes Research Foundation Fund. Makes conforming changes throughout the Law. Amends the Department of Public Health Act. Provides that the Department of Public Health shall administer the Juvenile Diabetes Research Foundation Fund and shall pass all of the moneys deposited in the Fund as grants to the Juvenile Diabetes Research Foundation for (i) research, treatment, and awareness of diabetes and (ii) improved diabetes self-management and training. Makes a corresponding change to the State Finance Act.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Findings. The General Assembly finds:
5        (1) The Juvenile Diabetes Research Foundation's
6    mission is to improve lives today and tomorrow by
7    accelerating life-changing breakthroughs to cure, prevent,
8    and treat type 1 diabetes and its complications.
9        (2) Type 1 diabetes is an autoimmune disease in which
10    insulin-producing beta cells in the pancreas are
11    mistakenly destroyed by the body's immune system.
12        (3) It is estimated that 64,000 children and adults
13    are diagnosed annually, and 2,100,000 children and adults
14    are expected to be diagnosed with type 1 diabetes by 2040.
15        (4) In addition to accelerating research, the Juvenile
16    Diabetes Research Foundation supports those impacted by
17    type 1 diabetes via community forums, events, and
18    resources in English and Spanish.
 
19    Section 5. The Illinois Lottery Law is amended by changing
20Sections 9.3 and 20 and by adding Section 21.15 as follows:

1proceeds.
2    (a) Beginning July 1, 2022, except as provided in Sections
321.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and 21.13,
4and 21.15 of this Law Act and Section 25-70 of the Sports
5Wagering Act, the Department shall distribute all proceeds of
6lottery tickets and shares sold in the following priority and
7manner:
8        (1) The payment of prizes and retailer bonuses.
9        (2) The payment of costs incurred in the operation and
10    administration of the Lottery, including the payment of
11    sums due to the private manager under the management
12    agreement with the Department and including costs of
13    administering the Lottery sports wagering program pursuant
14    to Section 25-70 of the Sports Wagering Act.
15        (3) On the last day of each month or as soon thereafter
16    as possible, the State Comptroller shall direct and the
17    State Treasurer shall transfer from the State Lottery Fund
18    to the Common School Fund the Department's estimate of net
19    lottery proceeds.
20        (4) If an amount in excess of the annual net lottery
21    proceeds is transferred for a fiscal year, then the
22    Department shall offset the monthly transfers of estimated
23    net lottery proceeds during the following fiscal year by
24    that excess amount. If an amount less than the annual net
25    lottery proceeds is transferred for a fiscal year, then
26    after the related annual fiscal year audit is completed

1    following such fiscal year, the Department shall direct
2    the deposit of any remaining annual net lottery proceeds
3    from such fiscal year, subject to payments under
4    paragraphs (1) and (2), into the Common School Fund as
5    soon thereafter as possible.
6    (b) The net lottery proceeds shall be determined by
7deducting from total annual lottery proceeds the expenditures
8required by paragraphs (1) and (2) of subsection (a). The
9total annual lottery proceeds and annual net lottery proceeds
10shall be determined according to generally accepted accounting
11principles for governmental entities and verified by an annual
12fiscal year audit.

15    Sec. 20. State Lottery Fund.
16    (a) There is created in the State Treasury a special fund
17to be known as the State Lottery Fund. Such fund shall consist
18of all revenues received from (1) the sale of lottery tickets
19or shares, (net of commissions, fees representing those
20expenses that are directly proportionate to the sale of
21tickets or shares at the agent location, and prizes of less
22than $600 which have been validly paid at the agent level), (2)
23application fees, and (3) all other sources including moneys
24credited or transferred thereto from any other fund or source
25pursuant to law. Interest earnings of the State Lottery Fund

1shall be credited to the Common School Fund.
2    (b) The receipt and distribution of moneys under Section
321.5 of this Law Act shall be in accordance with Section 21.5.
4    (c) The receipt and distribution of moneys under Section
521.6 of this Law Act shall be in accordance with Section 21.6.
6    (d) The receipt and distribution of moneys under Section
721.7 of this Law Act shall be in accordance with Section 21.7.
8    (e) The receipt and distribution of moneys under Section
921.8 of this Law Act shall be in accordance with Section 21.8.
10    (f) The receipt and distribution of moneys under Section
1121.9 of this Law Act shall be in accordance with Section 21.9.
12    (g) The receipt and distribution of moneys under Section
1321.10 of this Law Act shall be in accordance with Section
1421.10.
15    (h) The receipt and distribution of moneys under Section
1621.11 of this Law Act shall be in accordance with Section
1721.11.
18    (i) The receipt and distribution of moneys under Section
1921.12 of this Law Act shall be in accordance with Section
2021.12.
21    (j) The receipt and distribution of moneys under Section
2221.13 of this Law Act shall be in accordance with Section
2321.13.
24    (j-5) The receipt and distribution of moneys under Section
2521.15 of this Law shall be in accordance with Section 21.15.
26    (k) The receipt and distribution of moneys under Section

125-70 of the Sports Wagering Act shall be in accordance with
2Section 25-70 of the Sports Wagering Act.

5    (20 ILCS 1605/21.15 new)
6    Sec. 21.15. Scratch-off for type 1 diabetes research,
7support, education, and awareness.
8    (a) The Department shall offer a special instant
9scratch-off game for the benefit of the Juvenile Diabetes
10Research Foundation, Illinois Chapter, type 1 diabetes
11research, support, education, and awareness. The game shall
12commence on January 1, 2024 or as soon thereafter, at the
13discretion of the Director, as is reasonably practical. The
14operation of the game shall be governed by this Law and any
15rules adopted by the Department. If any provision of this
16Section is inconsistent with any other provisions of this Law,
17then this Section governs.
18    (b) The net revenue from the type 1 diabetes research,
19support, education, and awareness scratch-off game shall be
20deposited into the Juvenile Diabetes Research Foundation Fund.
21    Moneys received for the purposes of this Section,
22including, without limitation, net revenue from the special
23instant scratch-off game and from gifts, grants, and awards
24from any public or private entity, must be deposited into the
25fund.

1    For the purposes of this subsection, "net revenue" means
2the total amount for which tickets have been sold less the sum
3of the amount paid out in the prizes and the actual
4administrative expenses of the Department solely related to
5the scratch-off game under this Section.
6    (c) During the time that tickets are sold for the type 1
7diabetes research, support, education, and awareness
8scratch-off game, the Department shall not unreasonably
9diminish the efforts devoted to marketing any other instant
10scratch-off lottery game.
11    (d) The Department may adopt any rules necessary to
12implement and administer the provisions of this Section.
 
13    Section 10. The Department of Public Health Act is amended
14by adding Section 8.5 as follows:

16    Sec. 8.5. Administration of Juvenile Diabetes Research
17Foundation Fund. The Department shall administer the Juvenile
18Diabetes Research Foundation Fund. The Department shall pass
19all of the moneys deposited in the Fund as grants to the
20Juvenile Diabetes Research Foundation for (i) research,
21treatment, and awareness of diabetes and (ii) improved
22diabetes self-management and training. As used in this
23Section, "diabetes self-management and training" has the same
24meaning as in subsection (b) of Section 356w of the Illinois

2    Section 15. The State Finance Act is amended by adding
3Section 5.990 as follows:

5    Sec. 5.990. The Juvenile Diabetes Research Foundation
6Fund.
