SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the State-funded Facilities Temperature Control Act. Provides that by May 1, 2025, all State-funded facilities shall have permanent cooling and dehumidification equipment capable of maintaining a room temperature of 75 degrees Fahrenheit, or 24 degrees Celsius, and 50% relative humidity in all habitable spaces, toilet rooms, and public corridors, when: the outdoor temperature is 84 degrees Fahrenheit, or 28.9 degrees Celsius, or higher; or the heat index reaches or exceeds 80 degrees Fahrenheit, or 26.7 degrees Celsius. Provides that the owner or operator of the State-funded facility shall provide and maintain all fixed cooling systems. Provides that fans that do not produce refrigerated air shall not be considered cooling systems. Defines terms. Effective January 1, 2024.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5State-funded Facilities Temperature Control Act.
 
6    Section 5. Definitions. In this Act:
7    "Assisted living establishment" has the meaning given to
8it in Section 10 of the Assisted Living and Shared Housing Act.
9    "Day care center" as the meaning given to it in 89 Ill.
10Adm. Code 407.
11    "Facilities" include: (i) day care centers; (ii) assisted
12living establishments that provide services to seniors; (iii)
13shared housing establishments that provide services to
14seniors; (iv) supportive living facilities that provide
15services to seniors; (v) a community living facility as
16defined in the Community Living Facilities Licensing Act; and
17(vi) a long-term care facility licensed under the Nursing Home
18Care Act that provides services to seniors.
19    "Senior" means a person aged 60 or over.
20    "Shared housing establishment" has the meaning given to it
21in Section 10 of the Assisted Living and Shared Housing Act.
22    "Supportive living facility" means a facility established
23under Section 5-5.01a of the Illinois Public Aid Code.

1    Section 10. State-funded facilities temperature control.
2By May 1, 2025, all State-funded facilities shall have

4maintaining a room temperature of 75 degrees Fahrenheit, or 24
5degrees Celsius, and 50% relative humidity in all habitable
6spaces, toilet rooms, and public corridors, when:
7        (1) the outdoor temperature is 84 degrees Fahrenheit,
8    or 28.9 degrees Celsius, or higher; or
9        (2) the heat index reaches or exceeds 80 degrees
10    Fahrenheit, or 26.7 degrees Celsius.
11    The owner or operator of the State-funded facility shall

14systems within the meaning of this Section.
 
15    Section 99. Effective date. This Act takes effect January
