SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-1-15 new

    Amends the Illinois Municipal Code. Provides that a municipality that uses an automated railroad grade crossing enforcement system, automated speed enforcement system, or automated traffic law enforcement system must share any data collected by the system or systems with the Illinois State Police or a municipal law enforcement agency upon the request of the Illinois State Police or municipal law enforcement agency. Provides that a municipality may not enter into, modify, or extend a contract that would prohibit the release of the information. Limits the concurrent exercise of home rule powers.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 11-1-15 as follows:
 
6    (65 ILCS 5/11-1-15 new)
7    Sec. 11-1-15. Automated camera enforcement system data
8sharing.
9    (a) As used in this Section:
10    "Automated railroad grade crossing enforcement system" has
11the meaning given to that term in Section 11-1201.1 of the
12Illinois Vehicle Code.
13    "Automated speed enforcement system" has the meaning given
14to that term in Section 11-208.8 of the Illinois Vehicle Code.
15    "Automated traffic law enforcement system" has the
16meanings given to that term in Sections 11-208.6 and 11-208.9
17of the Illinois Vehicle Code.
18    (b) A municipality that uses an automated railroad grade
19crossing enforcement system, automated speed enforcement
20system, or automated traffic law enforcement system must share
21any data collected by the system or systems with the Illinois
22State Police or a municipal law enforcement agency upon the
23request of the Illinois State Police or municipal law

1enforcement agency.
2    (c) A municipality may not enter into, modify, or extend a
3contract that would prohibit the release of information under
4subsection (b).
5    (d) A home rule municipality may not regulate an automated
6railroad grade crossing enforcement system, automated speed
7enforcement system, or automated traffic law enforcement
8system in a manner inconsistent with this Section. This
9Section is a limitation under subsection (i) of Section 6 of
10Article VII of the Illinois Constitution on the concurrent
11exercise by home rule units of powers and functions exercised
12by the State.
