SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-30.11

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that to ensure a behavioral health clinic that is enrolled as a provider under the medical assistance program maintains staff who are licensed to engage in the practice of applied behavior analysis, the Department of Healthcare and Family Services shall, by rule, include a behavioral analyst licensed under the Behavior Analyst Licensing Act to the Department's definition of "licensed practitioner of the healing arts". Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-30.11 as follows:
 
6    (305 ILCS 5/5-30.11)
7    Sec. 5-30.11. Treatment of autism spectrum disorder.
8    (a) Treatment of autism spectrum disorder through applied
9behavior analysis shall be covered under the medical
10assistance program under this Article for children with a
11diagnosis of autism spectrum disorder when ordered by: (1) a
12physician licensed to practice medicine in all its branches
13and rendered by a licensed or certified health care
14professional with expertise in applied behavior analysis; or
15(2) when evaluated and treated by a behavior analyst licensed
16by the Department of Financial and Professional Regulation to
17practice applied behavior analysis in this State. Such
18coverage may be limited to age ranges based on evidence-based
19best practices. Appropriate State plan amendments as well as
20rules regarding provision of services and providers will be
21submitted by September 1, 2019.
22    (b) To ensure a behavioral health clinic that meets the
23criteria established by the Department under 89 Ill. Adm. Code

1140.499 and 89 Ill. Adm. Code 140.TABLE O maintains staff who
2are licensed to engage in the practice of applied behavior
3analysis, the Department shall, by rule, include a behavioral
4analyst licensed under the Behavior Analyst Licensing Act to
5the Department's definition of "licensed practitioner of the
6healing arts".

9    Section 99. Effective date. This Act takes effect upon
10becoming law.
