SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2BBBB new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice within the meaning of the Act for a motor vehicle dealer or a manufacturer of motor vehicles sold or leased in this State to offer to a consumer a subscription service for any motor vehicle feature that: (1) utilizes components and hardware already installed on the motor vehicle at the time of purchase or lease by the consumer; and (2) would function after activation without ongoing expense to the dealer, manufacturer, or any third-party service provider. Effective immediately.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2BBBB as follows:
 
6    (815 ILCS 505/2BBBB new)
7    Sec. 2BBBB. Motor vehicle subscription services.
8    (a) As used in this Section:
9    "Manufacturer" means a person or business engaged in the
10manufacturing or assembling of new motor vehicles.
11    "Motor vehicle" includes all vehicles propelled otherwise
12than by muscular power, excepting such vehicles as run only
13upon rails or tracks, low-speed electric bicycles, low-speed
14electric scooters, and motorized bicycles.
15    "Motor vehicle dealer" means any business that engages in
16the selling or leasing of new or used motor vehicles to
17consumers.
18    "Motor vehicle feature" means any convenience or safety
19function included on the motor vehicle, such as heated seats
20or driver assistance that typically is offered to a consumer
21as an upgrade at the time of purchase or lease of the motor
22vehicle.
23    "Subscription service" means a service provided on a

1subscription basis in exchange for a recurring payment,
2including, but not limited to, a weekly, monthly, or annual
3payment charged to and made by a consumer.
4    (b) It is an unlawful practice within the meaning of this
5Act for a motor vehicle dealer or a manufacturer of motor
6vehicles sold or leased in this State to offer to a consumer a
7subscription service for any motor vehicle feature that: (1)
8utilizes components and hardware already installed on the
9motor vehicle at the time of purchase or lease by the consumer;
10and (2) would function after activation without ongoing
11expense to the dealer, manufacturer, or any third-party
12service provider.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.
