SYNOPSIS AS INTRODUCED:
 
20 ILCS 301/55-31 new
305 ILCS 5/5-41a new

    Amends the Substance Use Disorder Act and the Medical Assistance Article of the Illinois Public Aid Code. Provides that a provider, including a provider enrolled in the medical assistance program, that is licensed and contracted by the Department of Human Services to provide Level 3.5 and 3.5D residential services or Level 3.7D withdrawal management services for persons with a substance use disorder shall be paid the contracted rate for the day of discharge if, as a result of the Department's September 1, 2020 changes to reimbursement rates and methodology standards, the provider's contracted reimbursement rate is not sufficient to offset any loss of revenue associated with the Department's prohibition on billing for the day of discharge.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Substance Use Disorder Act is amended by
5adding Section 55-31 as follows:
 
6    (20 ILCS 301/55-31 new)
7    Sec. 55-31. Residential services; day of discharge rate. A
8provider licensed and contracted by the Department to provide
9Level 3.5 and 3.5D residential services or Level 3.7D
10withdrawal management services to persons with a substance use
11disorder shall be paid the contracted rate for the day of
12discharge if, as a result of the Department's September 1,
132020 changes to reimbursement rates and methodology standards,
14the provider's contracted reimbursement rate is not sufficient
15to offset any loss of revenue associated with the Department's
16prohibition on billing for the day of discharge.
 
17    Section 10. The Illinois Public Aid Code is amended by
18adding Section 5-41a as follows:
 
19    (305 ILCS 5/5-41a new)
20    Sec. 5-41a. Residential services for substance use

1medical assistance program that is licensed and contracted by
2the Department of Human Services' Division of Substance Use
3Prevention and Recovery to provide Level 3.5 and 3.5D
4residential services or Level 3.7D withdrawal management
5services to persons with a substance use disorder shall be
6paid the contracted rate for the day of discharge under the
7medical assistance program if, as a result of the Department
8of Human Services' September 1, 2020 changes to reimbursement
9rates and methodology standards, the provider's contracted
10reimbursement rate is not sufficient to offset any loss of
11revenue associated with the Department's prohibition on
12billing for the day of discharge.
