SYNOPSIS AS INTRODUCED:

815 ILCS 505/2BBBB new

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that the furnishing of health care services by a health care professional or health care provider may not be conditioned on the patient providing a credit card number to be kept on file by the health care professional or health care provider. Provides that a violation constitutes an unlawful practice within the meaning of the Act.

A BILL FOR

AN ACT concerning business.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Consumer Fraud and Deceptive Business Practices Act is amended by adding Section 2BBBB as follows:

Sec. 2BBBB. Use of credit cards when providing health care services.

(a) As used in this Section:

"Health care professional" means a physician, registered professional nurse, or other individual appropriately licensed or registered to provide health care services.

"Health care provider" means any physician, hospital facility, facility licensed under the Home Nursing Care Act, long-term care facility as defined in Section 1-113 of the Nursing Home Care Act, or other person that is appropriately licensed or registered to provide health care services. "Health care provider" does not include independent practice associations or physician-hospital organizations.

"Patient" means the individual who is receiving health care services from the health care professional or health care provider and any individual who is the guarantor of the payment for such services.

(b) The furnishing of health care services by a health care professional or health care provider may not be conditioned on the patient providing a credit card number to be kept on file by the health care professional or health care provider.

(c) A violation of this Section constitutes an unlawful practice within the meaning of this Act.
