SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/1-140.20 new
625 ILCS 5/3-122 new
625 ILCS 5/3-804.3

    Amends the Illinois Vehicle Code. Defines "M998 HMMWV" as an AM General Series M998 High-Mobility Multipurpose Wheeled Vehicle produced for military or government use. Provides that the owner of an M998 HMMWV may register the vehicle as a former military vehicle if specified conditions are met. Provides that a certificate of title issued for an M998 HMMWV shall not indicate that the M998 HMMWV is limited to off-road use.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Sections 1-140.20 and 3-122 and by changing Section 3-804.3 as
6follows:
 
7    (625 ILCS 5/1-140.20 new)
8    Sec. 1-140.20. M998 HMMWV. An AM General Series M998
9High-Mobility Multipurpose Wheeled Vehicle produced for
10military or government use.
 
11    (625 ILCS 5/3-122 new)
12    Sec. 3-122. M998 HMMWV; certificate of title. A
13certificate of title issued for an M998 HMMWV shall not
14indicate that the M998 HMMWV is limited to off-road use if the
15applicant for the certificate of title and the M998 HMMWV meet
16the requirements of paragraph (e)(1) of Section 3-804.3.

18    Sec. 3-804.3. Former military vehicles.
19    (a) The owner of a former military vehicle may register
20the vehicle for a fee not to exceed:
21        (1) $100 for a vehicle with a gross vehicle weight

1    rating of 26,000 pounds or less;
2        (2) $150 for a vehicle with a gross vehicle weight
3    rating of 26,001 to 45,000 pounds;
4        (3) $500 for a vehicle with a gross vehicle weight
5    rating of 45,001 to 65,000 pounds;
6        (4) $1,000 for a vehicle with a gross vehicle weight
7    rating of over 65,000 pounds; or
8        (5) $25 for a trailer with a weight of 3,000 pounds or
9    less; or
10        (6) $75 for a trailer with a weight of over 3,000
11    pounds.
12    (b) The Secretary may prescribe, in the Secretary's
13discretion, that former military vehicle plates be issued for
14a definite or an indefinite term, such term to correspond to
15the term of registration plates issued generally, as provided
16in Section 3-414.1. Any person requesting former military
17vehicle plates under this Section may also apply to have
18vanity or personalized plates as provided under Section
193-405.1.
20    (c) A vehicle registered as a former military vehicle is
21not subject to Section 3-815 and 3-818 of this Code.
22    (d) A vehicle may not be registered under this Section
23unless a title for the vehicle has been issued by the Secretary
24and the vehicle is eligible for registration without regard to
25its status as a military vehicle.
26    (e)(1) Notwithstanding the provisions of subsection (d),

1the owner of an M998 HMMWV may register the vehicle as a former
2military vehicle if all of the following conditions are met:
3        (A) The owner is a former or current member of the
4    United States Armed Forces who provides proof to the
5    Secretary that he or she possesses or formerly possessed a
6    military license to operate the vehicle.
7        (B) Before registration, the M998 HMMWV successfully
8    completes an inspection by the Secretary regarding the
9    suitability for limited use of the M998 HMMWV upon the
10    highways of this State as set forth in paragraph (2). The
11    fee for the inspection shall not exceed $50. The
12    Secretary, in the Secretary's discretion, may accept the
13    owner's affidavit regarding safety modifications and
14    equipment standards in lieu of the inspection. The
15    Secretary shall give the owner a temporary registration so
16    that the owner may drive the M998 HMMWV on a direct route
17    to and from the inspection point.
18        (C) A keyed ignition cutoff switch is installed in the
19    M998 HMMWV.
20        (D) A battery power cutoff switch is installed in the
21    M998 HMMWV.
22    (2) Operation of a registered M998 HMMWV upon the highways
23of this State is permitted only if all of the following
24conditions are met:
25        (A) Operation of the M998 HMMWV is limited to
26    ceremonies, parades, and educational events and

1    transportation to and from ceremonies, parades, and
2    educational events.
3        (B) The operator, if not the owner, meets the
4    requirements of subparagraph (1)(B).
5        (C) At all times when operating the M998 HMMWV, the
6    operator is accompanied by an assistant driver who
7    possesses a valid Illinois driver's license.
