SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Electric Vehicle Charger Grant Act. Provides that any State agency that disburses grant funds for electric vehicle charging stations must include provisions in the criteria for awarding grant funds that encourage the use of equity eligible contractors by the grantees. Provides that the provisions shall include, but not be limited to, additional points to those grantees who commit to exclusively using equity eligible contractors, a portion of the grant funds devoted exclusively for equity eligible contractors, and inclusion of aspirational goals for all grantees to use equity eligible contractors. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Electric Vehicle Charger Grant Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Electric vehicle charging system" means a device that is:
8(i) used to provide electricity to an electric vehicle; (ii)
9designed to ensure that a safe connection has been made
10between the electric grid and the eclectic vehicle; and (iii)
11able to communicate with the vehicle's control system so that
12electricity flows at an appropriate voltage and current level.
13An "electric vehicle charging system" may be wall mounted or
14pedestal style, may provide multiple cords to connect with
15electric vehicles, shall be certified by Underwriters
16Laboratories or have been granted an equivalent certification,
17and shall comply with the current version of Article 625 of the
18National Electrical Code.
19    "Equity eligible contractor" means a business that is
20majority-owned by eligible persons, or a nonprofit or
21cooperative that is majority-governed by eligible persons, or
22is a natural person who is an eligible person offering
23personal services as an independent contractor.

1    "Grant funds" means any public funds dispensed by a
2grantor agency to any person or entity for obligation,
3expenditure, or use by that person or entity for installing,
4maintaining, purchasing or repairing an electric vehicle
5charging system. Neither the method by which funds are
6dispensed, whether by contract, agreement, grant subsidy,
7letter of credit, or any other method, nor the purpose for
8which the funds are used can change the character of funds
9which otherwise would be considered grant funds as defined in
10this Section.
11    "Grantee" means the person or entity which may use grant
12funds.
13    "Grantor agency" means a State agency that dispenses grant
14funds.
15    "State agency" means State-supported universities and
16colleges and any department, office, commission, board, or
17authority within the Executive Department, other than the
18Office of the Lieutenant Governor, the Office of the Attorney
19General, the Office of the Secretary of State, the Office of
20the Comptroller, or the Office of the State Treasurer.
 
21    Section 10. Disbursement of grant funds relating to
22electric vehicle chargers. Any State agency that disburses
23grant funds for electric vehicle charging stations must
24include provisions in the criteria for awarding grant funds
25that encourage the use of equity eligible contractors by the

1grantees. These provisions to encourage the use of equity
2eligible contractors shall include, but not be limited to,
3additional points to those grantees who commit to exclusively
4using equity eligible contractors, a portion of the grant
5funds devoted exclusively for equity eligible contractors, and
6inclusion of aspirational goals for all grantees to use equity
7eligible contractors.
 
8    Section 99. Effective date. This Act takes effect upon
9becoming law.
