SYNOPSIS AS INTRODUCED:
 
705 ILCS 105/27.3  from Ch. 25, par. 27.3

    Amends the Clerks of Courts Act. Removes language providing for the compensation of Clerks of the Circuit Court. Provides instead that the salary of a clerk of the circuit court elected or appointed after the effective date of the amendatory Act shall be set as a percentage of the salary of Judges of the Circuit Court and shall be in the following amounts: in counties where the population is less than 14,000, 55%; in counties where the population is 14,001 to 30,000, 60%; in counties where the population is 30,001 to 60,000, 65%; in counties where the population is 60,001 to 100,000, 70%; in counties where the population is is 100,001 to 200,000, 75%; in counties where the population is 200,001 to 300,000, 80%; in counties where the population is 300,001 to 3,000,000, 85%; and in counties where the population is over 3,000,000, 90%. Requires the State to furnish 66 2/3% of the total annual salary to be paid to a clerk of the circuit court, and the county to furnish 33 1/3% of the total annual salary. Provides that if, on the effective date of the amendatory Act, the salary of a clerk is greater than the percentage of the circuit judges salary in the provisions, that circuit clerk's salary shall not be reduced.

1    AN ACT concerning courts.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Clerks of Courts Act is amended by changing
5Section 27.3 as follows:
 
6    (705 ILCS 105/27.3)  (from Ch. 25, par. 27.3)
7    Sec. 27.3. Compensation.
8    (a) The salary of a clerk of the circuit court elected or
9appointed after the effective date of this amendatory act of
10the 103rd General Assembly shall be set as a percentage of the
11salary of Judges of the Circuit Court as defined in Section 3.2
12of the Salaries Act. The The county board shall provide the
13compensation of Clerks of the Circuit Court, and the amount
14necessary for clerk hire, stationery, fuel and other expenses.
15Beginning December 1, 1989, the compensation per annum for
16Clerks of the Circuit Court shall be as follows:
17    In counties where the population is:
18Less than 14,000..........55% at least $13,500
1914,001-30,000.............60% at least $14,500
2030,001-60,000.............65% at least $15,000
2160,001-100,000............70% at least $15,000
22100,001-200,000........... 75% at least $16,500
23200,001-300,000........... 80% at least $18,000

1300,001- 3,000,000........ 85% at least $20,000
2Over 3,000,000............ 90% at least $55,000
3    As used in this Section, "salary" is exclusive of any
4other compensation or benefit.
5    (a-1) The State shall furnish 66 2/3% of the total annual
6salary to be paid to a clerk of the circuit court. The county
7shall furnish 33 1/3% of the total annual salary. If, on the
8effective date of this amendatory Act of the 103rd General
9Assembly, the salary of a clerk is greater than the salary set
10forth in this Section, that circuit clerk's salary shall not
11be reduced.
12    (b) (Blank). In counties in which the population is
133,000,000 or less, "base salary" is the compensation paid for
14each Clerk of the Circuit Court, respectively, before July 1,
151989.
16    (c) (Blank). The Clerks of the Circuit Court, in counties
17in which the population is 3,000,000 or less, shall be
18compensated as follows:
19        (1) Beginning December 1, 1989, base salary plus at
20    least 3% of base salary.
21        (2) Beginning December 1, 1990, base salary plus at
22    least 6% of base salary.
23        (3) Beginning December 1, 1991, base salary plus at
24    least 9% of base salary.
25        (4) Beginning December 1, 1992, base salary plus at
26    least 12% of base salary.

1    (d) In addition to the compensation provided by the county
2board, each Clerk of the Circuit Court shall receive an award
3from the State for the additional duties imposed by Sections
45-9-1 and 5-9-1.2 of the Unified Code of Corrections, Section
510 of the Violent Crime Victims Assistance Act, and other
6laws, in the following amount:
7        (1) $3,500 per year before January 1, 1997.
8        (2) $4,500 per year beginning January 1, 1997.
9        (3) $5,500 per year beginning January 1, 1998.
10        (4) $6,500 per year beginning January 1, 1999.
11The total amount required for such awards shall be
12appropriated each year by the General Assembly to the Supreme
13Court, which shall distribute such awards in annual lump sum
14payments to the Clerks of the Circuit Court in all counties.
15This annual award, and any other award or stipend paid out of
16State funds to the Clerks of the Circuit Court, shall not
17affect any other compensation provided by law to be paid to
18Clerks of the Circuit Court.
19    (e) (Blank).
20    (f) No county board may reduce or otherwise impair the
21compensation payable from county funds to a Clerk of the
22Circuit Court if the reduction or impairment is the result of
23the Clerk of the Circuit Court receiving an award or stipend
24payable from State funds.
