SYNOPSIS AS INTRODUCED:
 
10 ILCS 5/20-2.2  from Ch. 46, par. 20-2.2

    Amends the Election Code. Provides that if a voter is a United States citizen and has never lived in the United States but has a parent or legal guardian who is a qualified elector, then that person is eligible to register and vote in federal elections where his or her parent is a qualified elector. Effective immediately.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Section 20-2.2 as follows:
 
6    (10 ILCS 5/20-2.2)  (from Ch. 46, par. 20-2.2)
7    Sec. 20-2.2. Any non-resident civilian citizen, otherwise
8qualified to vote, may make application to the election
9authority having jurisdiction over his precinct of former
10residence for a vote by mail ballot containing the Federal
11offices only not less than 10 days before a Federal election.
12If the voter is a United States citizen and has never lived in
13the United States but has a parent or legal guardian who is a
14qualified elector pursuant to this Article, then that person
15is eligible to register and vote in federal elections where
16his or her parent is a qualified elector. Such application may
17be made on the official postcard or by facsimile or electronic
18transmission. A request pursuant to this Section shall entitle
19the applicant to a vote by mail ballot for every election in
20one calendar year at which Federal offices are filled. The
21original application for ballot shall be kept in the office of
22the election authority for one year as authorization to send a
23ballot to the voter for each election to be held within that

1calendar year at which Federal offices are filled. A certified
2copy of such application for ballot shall be sent each
3election with the vote by mail ballot to the election
4authority's central ballot counting location to be used in
5lieu of the original application for ballot. No registration
6shall be required in order to vote pursuant to this Section.
7Ballots under this Section shall be delivered by the election
8authority in the manner prescribed by Section 20-5 of this
9Article in person, by mail, or, if requested by the applicant
10and the election authority has the capability, by facsimile
11transmission or by electronic transmission. Ballots voted
12under this Section must be returned postmarked no later than
13election day and received for counting at the central ballot
14counting location of the election authority during the period
15for counting provisional ballots, the last day of which is the
1614th day following election day.

18    Section 99. Effective date. This Act takes effect upon
19becoming law.
