SYNOPSIS AS INTRODUCED:

745 ILCS 10/2-109.5 new

Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that a local public entity is not liable for the bodily injury or death of a driver or passenger in a stolen vehicle if the plaintiff was, during the course of the alleged negligence, in flight or fleeing apprehension during the commission of the offense of fleeing or attempting to elude a peace officer or aggravated fleeing or attempting to elude a peace officer. Effective immediately.

A BILL FOR

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Local Governmental and Governmental Employees Tort Immunity Act is amended by adding Section 2-109.5 as follows:

(745 ILCS 10/2-109.5 new)

Sec. 2-109.5. Injury or death caused by fleeing or attempting to elude peace officer in stolen vehicle. A local public entity is not liable for the bodily injury or death of a driver or passenger in a stolen vehicle if the plaintiff was, during the course of the alleged negligence, in flight or fleeing apprehension during the commission of the offense of fleeing or attempting to elude a peace officer or aggravated fleeing or attempting to elude a peace officer.

Section 99. Effective date. This Act takes effect upon becoming law.
