SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/3.1-10-5.5 new

    Amends the Illinois Municipal Code. Provides that a person who has been convicted of a felony under the laws of this State, another state, or the federal government is eligible to serve on a District Council if the person is not incarcerated. Defines "District Council". Limits the concurrent exercise of home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 3.1-10-5.5 as follows:
 
6    (65 ILCS 5/3.1-10-5.5 new)
7    Sec. 3.1-10-5.5. City of Chicago District Councils.
8    (a) As used in this Section, "District Council" means a
9District Council established under Section 2-80-070 of the
10Municipal Code of Chicago, as that Section appeared on July
1121, 2021, or any successor body established by the City of
12Chicago that exercises any one or more of the functions
13delegated to a District Council under that ordinance.
14    (b) Notwithstanding any other provision of law, a person
15who has been convicted of a felony under the laws of this
16State, another state, or the federal government is eligible to
17serve on a District Council if the person is not incarcerated.
18    (c) The City of Chicago may not regulate District Councils
19in a manner inconsistent with this Section. This Section is a
20limitation under subsection (i) of Section 6 of Article VII of
21the Illinois Constitution on the concurrent exercise by home
22rule units of powers and functions exercised by the State.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
