SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/3.1-55-30 new

    Amends the Illinois Municipal Code. Provides that a municipality may not prohibit a speaker at a public meeting from addressing an individual member of the city council, a municipal official, or a staff member of these individuals, except that these provisions do not prohibit a municipality from limiting when a speaker may speak at a meeting. Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 3.1-55-30 as follows:
 
6    (65 ILCS 5/3.1-55-30 new)
7    Sec. 3.1-55-30. Addressing city council members at public
8meetings.
9    (a) Notwithstanding any other provision of law, a
10municipality may not prohibit a speaker at a public meeting
11from addressing an individual member of the city council, a
12municipal official, or a staff member of these individuals.
13This subsection does not prohibit a municipality from limiting
14when a speaker may speak at a meeting.
15    (b) A home rule municipality may not regulate addressing
16individual city council members, municipal officials, or staff
17members of these individuals at a city council meeting in a
18manner inconsistent with this Section. This Section is a
19limitation under subsection (i) of Section 6 of Article VII of
20the Illinois Constitution on the concurrent exercise by home
21rule units of powers and functions exercised by the State.
 
22    Section 99. Effective date. This Act takes effect upon
