1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Purpose. The purpose of this Act is to help
5homeless service providers receive federal resources during
6public health emergencies, including personal protective
7equipment for which the Federal Emergency Management Agency
8has final authority for reimbursement.
 
9    Section 5. The Department of Public Health Powers and
10Duties Law of the Civil Administrative Code of Illinois is
11amended by adding Section 2310-434 as follows:
 
12    (20 ILCS 2310/2310-434 new)
13    Sec. 2310-434. Homeless service providers.
14    (a) In this Section, "homeless service provider" means a
15person or entity who provides services to homeless persons
16under any of the programs of or identified by the Department of
17Human Services.
18    (b) The Department shall consider all homeless service
19providers in the State to be essential critical infrastructure
20workers in accordance with the most recent guidance from the
21federal Cybersecurity and Infrastructure Security Agency. The
22Department shall ensure that homeless service providers

1qualify for the same priority benefits afforded to frontline
2workers by the State, including, but not limited to:
3        (1) federal funding for relief relating to public
4    health emergencies;
5        (2) personal protective equipment; and
6        (3) vaccinations.
7    (c) In accordance with this Section, during a
8federally-designated public health emergency or a public
9health disaster declared by a proclamation issued by the
10Governor under Section 7 of the Illinois Emergency Management
11Agency Act, the Department and the Illinois Emergency
12Management Agency shall offer recommendations to their local
13counterparts, including local public health departments and
14local emergency management assistance agencies, encouraging
15them to consider homeless service providers when making
16determinations about providing assistance.
17    (d) The Department may adopt rules for the implementation
18and administration of this Section and to ensure that homeless
19service providers are considered essential critical
20infrastructure workers in the event of a pandemic.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
