SYNOPSIS AS INTRODUCED:
 
110 ILCS 305/120 new
110 ILCS 520/100 new
110 ILCS 660/5-210 new
110 ILCS 665/10-210 new
110 ILCS 670/15-210 new
110 ILCS 675/20-215 new
110 ILCS 680/25-210 new
110 ILCS 685/30-220 new

    Amends various Acts relating to the governance of public universities. Provides that the boards of trustees shall provide by rule or contract for a procedure to evaluate the performance and qualifications of non-tenured faculty members. Provides that, if the implementation of the procedure results in a decision to dismiss a non-tenured faculty member for the ensuing academic year or term, the Board shall give notice to the faculty member not later than 60 days before the end of the academic year or term. Provides that, if the Board fails to give the notice within the time period, the faculty member shall be deemed reemployed for the ensuing academic year. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Act is amended by
5adding Section 120 as follows:
 
6    (110 ILCS 305/120 new)
7    Sec. 120. Dismissal of non-tenured faculty member. The
8Board of Trustees shall provide by rule or contract for a
9procedure to evaluate the performance and qualifications of
10non-tenured faculty members. If the implementation of such
11procedure results in a decision to dismiss a non-tenured
12faculty member for the ensuing academic year or term, the
13Board shall give notice thereof to the faculty member not
14later than 60 days before the end of the academic year or term.
15The specific reasons for the dismissal shall be confidential
16but shall be issued to the faculty member upon request. If the
17Board fails to give such notice within the time period, the
18faculty member shall be deemed reemployed for the ensuing
19academic year.
 
20    Section 10. The Southern Illinois University Management
21Act is amended by adding Section 100 as follows:

3Board shall provide by rule or contract for a procedure to
4evaluate the performance and qualifications of non-tenured
5faculty members. If the implementation of such procedure
6results in a decision to dismiss a non-tenured faculty member
7for the ensuing academic year or term, the Board shall give
8notice thereof to the faculty member not later than 60 days
9before the end of the academic year or term. The specific
10reasons for the dismissal shall be confidential but shall be
11issued to the faculty member upon request. If the Board fails
12to give such notice within the time period, the faculty member
13shall be deemed reemployed for the ensuing academic year.
 
14    Section 15. The Chicago State University Law is amended by
15adding Section 5-210 as follows:

17    Sec. 5-210. Dismissal of non-tenured faculty member. The
18Board shall provide by rule or contract for a procedure to
19evaluate the performance and qualifications of non-tenured
20faculty members. If the implementation of such procedure
21results in a decision to dismiss a non-tenured faculty member
22for the ensuing academic year or term, the Board shall give
23notice thereof to the faculty member not later than 60 days

10evaluate the performance and qualifications of non-tenured
11faculty members. If the implementation of such procedure
12results in a decision to dismiss a non-tenured faculty member
13for the ensuing academic year or term, the Board shall give
14notice thereof to the faculty member not later than 60 days
15before the end of the academic year or term. The specific
16reasons for the dismissal shall be confidential but shall be
17issued to the faculty member upon request. If the Board fails

21by adding Section 15-210 as follows:

19faculty members. If the implementation of such procedure

21for the ensuing academic year or term, the Board shall give

17evaluate the performance and qualifications of non-tenured
18faculty members. If the implementation of such procedure
19results in a decision to dismiss a non-tenured faculty member
20for the ensuing academic year or term, the Board shall give
21notice thereof to the faculty member not later than 60 days
22before the end of the academic year or term. The specific
23reasons for the dismissal shall be confidential but shall be

3    Section 99. Effective date. This Act takes effect upon
4becoming law.
