SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the COVID-19 Workplace Vaccination Program Limitation Act. Provides that it is unlawful for an employer in the State of Illinois to create, implement, or otherwise enforce a workplace vaccination program that requires any employee to demonstrate to the employer that he or she has received a vaccine that was approved under emergency use authorization by the United States Food and Drug Administration. Provides for repeal of the Act on January 1, 2023. Effective immediately.

1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5COVID-19 Workplace Vaccination Program Limitation Act.
 
6    Section 5. Purpose. It is the purpose of this Act to allow
7individuals to have the autonomy to make the decision of
8whether or not to receive a vaccination that was approved by
9the United States Food and Drug Administration to be used
10under emergency use authorization for treatment of COVID-19.
11The fact that the vaccines made available amid the global
12pandemic have been granted emergency use authorization means
13that both regulatory bodies and industry experts have not been
14allotted sufficient time to study either the short-term and
15long-term effects that may arise from the administration of
16vaccinations authorized for emergency use. Therefore, the
17State is compelled to prohibit employers from requiring that
18employees receive a vaccine that has been approved under
19emergency use authorization as a condition of employment.
 
20    Section 10. Prohibition. It is unlawful for an employer in
21the State of Illinois to create, implement, or otherwise
22enforce a workplace vaccination program that requires an

1employee to demonstrate to the employer that he or she has
2received a vaccine that was approved under emergency use
3authorization by the United States Food and Drug
4Administration, under the Administration's power outlined in
5Section 564 of the Federal Food, Drug, and Cosmetic Act, for
6protection against COVID-19.
 
7    Section 95. Repeal. This Act is repealed on January 1,
82023.
 
9    Section 99. Effective date. This Act takes effect upon
10becoming law.
