1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Act is amended by
5adding Section 120 as follows:
 
6    (110 ILCS 305/120 new)
7    Sec. 120. Carbon capture, utilization, and storage report.
8    (a) Subject to appropriation, the Prairie Research
9Institute at the University of Illinois at Urbana-Champaign,
10in consultation with an intergovernmental advisory committee,
11must file a report on the potential for carbon capture,
12utilization, and storage as a climate mitigation technology
13throughout Illinois with the Governor and the General Assembly
14no later than December 31, 2022. The report shall provide an
15assessment of Illinois subsurface storage resources, a
16description of existing and selected subsurface storage
17projects, and best practices for carbon storage. Additionally,
18the report shall provide recommendations for policy and
19regulatory needs at the State level based on its findings, and
20shall, at a minimum, address all the following areas:
21        (1) carbon capture, utilization, and storage current
22    status and future storage resource potential in the State.
23    Enhanced Oil Recovery shall remain outside the scope of

1    this study;
2        (2) procedures, standards, and safeguards for the
3    storage of carbon dioxide;
4        (3) permitting processes and the coordination with
5    applicable federal law or regulatory commissions,
6    including the Class VI injection well permitting process;
7        (4) economic impact, job creation, and job retention
8    from carbon capture, utilization, and storage that both
9    protects the environment and supports short-term and
10    long-term economic growth;
11        (5) development of knowledge capacity of appropriate
12    State agencies and stakeholders;
13        (6) environmental justice and stakeholder issues
14    related to carbon capture, utilization, and storage
15    throughout the State;
16        (7) leveraging federal policies and public-private
17    partnerships for research, design, and development to
18    benefit the State;
19        (8) liability for the storage and monitoring
20    maintenance of the carbon dioxide after the completion of
21    a carbon capture, utilization, and storage project;
22        (9) acquisition, ownership, and amalgamation of pore
23    space for carbon capture, utilization, and storage;
24        (10) methodologies to establish any necessary fees,
25    costs, or offsets; and
26        (11) any risks to health, safety, the environment, and

1    property uses or values.
2    (b) In developing the report under this Section, the
3Prairie Research Institute shall form an advisory committee,
4which shall be composed of all the following members:
5        (1) the Director of the Environmental Protection
6    Agency, or his or her designee;
7        (2) the Director of Natural Resources, or his or her
8    designee;
9        (3) the Director of Commerce and Economic Opportunity,
10    or his or her designee;
11        (4) the Director of the Illinois Emergency Management
12    Agency, or his or her designee;
13        (5) the Director of Agriculture, or his or her
14    designee;
15        (6) the Attorney General, or his or her designee;
16        (7) one member of the Senate, appointed by the
17    President of the Senate;
18        (8) one member of the House of Representatives,
19    appointed by the Speaker of the House of Representatives;
20        (9) one member of the Senate, appointed by the
21    Minority Leader of the Senate; and
22        (10) one member of the House of Representatives,
23    appointed by the Minority Leader of the House of
24    Representatives.
25    (c) No later than 60 days after the effective date of this
26amendatory Act of the 102nd General Assembly, the advisory

1committee shall hold its first meeting at the call of the
2Executive Director of the Prairie Research Institute, at which
3meeting the members shall select a chairperson from among
4themselves. After its first meeting, the committee shall meet
5at the call of the chairperson. Members of the committee shall
6serve without compensation. The Prairie Research Committee
7shall provide administrative support to the committee.
8    (d) The Prairie Research Institute shall also engage with
9interested stakeholders throughout the State to gain insights
10into socio-economic perspectives from environmental justice
11organizations, environmental non-governmental organizations,
12industry, landowners, farm bureaus, manufacturing, labor
13unions, and others.
14    (e) This Section is repealed on January 1, 2023.
 
15    Section 99. Effective date. This Act takes effect upon
16becoming law.
