SYNOPSIS AS INTRODUCED:

65 ILCS 5/11-80-25 new

Amends the Illinois Municipal Code. Provides that the corporate authorities of a municipality may use an existing utility pole within its public rights-of-way for municipal public safety purposes, including, but not limited to, the placing of equipment associated with public safety. Provides that any fee charged for the use of a utility pole shall be at the lowest rate charged by the entity owning the utility pole and shall not exceed the entity's actual costs.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by adding Section 11-80-25 as follows:

(65 ILCS 5/11-80-25 new)

Sec. 11-80-25. Municipal use of utility pole for public safety purposes.

(a) The corporate authorities of a municipality may use an existing utility pole within its public rights-of-way for municipal public safety purposes, including, but not limited to, the placing of equipment associated with public safety.

(b) Any fee charged for the use of a utility pole under this Section shall be at the lowest rate charged by the entity owning the utility pole and shall not exceed the entity's actual costs.
