SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-80-25 new

    Amends the Illinois Municipal Code. Provides that the corporate authorities of a municipality may use an existing utility pole within its public rights-of-way for municipal public safety purposes, including, but not limited to, the placing of equipment associated with public safety. Provides that any fee charged for the use of a utility pole shall be at the lowest rate charged by the entity owning the utility pole and shall not exceed the entity's actual costs.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 11-80-25 as follows:
 
6    (65 ILCS 5/11-80-25 new)
7    Sec. 11-80-25. Municipal use of utility pole for public
8safety purposes.
9    (a) The corporate authorities of a municipality may use an
10existing utility pole within its public rights-of-way for
11municipal public safety purposes, including, but not limited
12to, the placing of equipment associated with public safety.
13    (b) Any fee charged for the use of a utility pole under
14this Section shall be at the lowest rate charged by the entity
15owning the utility pole and shall not exceed the entity's
16actual costs.
