SYNOPSIS AS INTRODUCED:
 
5 ILCS 420/2-105 new

    Amends the Illinois Governmental Ethics Act. Provides that no person required to file a statement of economic interests under specified provisions, including employees of the Department of Transportation, shall, during the period of time for which he or she holds a position requiring disclosure of economic interests, hold any financial interest in or receive any compensation in the form of salary, wages, or commission from a provider of automated speed enforcement systems or automated traffic law enforcement systems. Provides that the provisions do not apply to candidates for office, and shall only apply if that candidate is elected to office. Requires the divestment of that financial interest. Defines terms. Effective immediately.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Governmental Ethics Act is amended
5by adding Section 2-105 as follows:
 
6    (5 ILCS 420/2-105 new)
7    Sec. 2-105. Red light camera financial interest
8prohibition.
9    (a) Except as otherwise provided in this subsection (a), no
10person required to file a statement of economic interests under
11subsections (a) and (b) of Section 4A-101 or Section 4A-101.5,
12or file as an employee of the Department of Transportation,
13shall, during the period of time for which he or she holds a
14position requiring disclosure of economic interests, hold any
15financial interest in or receive any compensation in the form
16of salary, wages, or commission from a provider of automated
17speed enforcement systems or automated traffic law enforcement
18systems. The requirements of this subsection (a) do not apply
19to candidates for office, and shall only apply if that
20candidate is elected to office.
21    (b) Any person prohibited from holding a financial interest
22in or receiving compensation from a provider of automated speed
23enforcement systems or automated traffic law enforcement

1systems under subsection (a) as of the effective date of this
2amendatory Act of the 101st General Assembly shall divest
3himself or herself of that interest within 30 days after the
4effective date of this amendatory Act of the 101st General
5Assembly.
6    (c) For the purposes of this Section:
7    "Automated speed enforcement systems" means a system as
8defined under Section 11-208.8 of the Illinois Vehicle Code.
9    "Automated traffic law enforcement systems" means a system
10as defined under Section 11-208.6 of the Illinois Vehicle Code.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
