    Amends the School Breakfast and Lunch Program Act. In the definitions of "free breakfast program" and "free lunch program" removes references to needy children. Requires every public school to have a free breakfast program. Repeals provisions concerning a breakfast incentive program and applications for participation in programs.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Breakfast and Lunch Program Act is
5amended by changing Sections 1 and 4 as follows:
 
6    (105 ILCS 125/1)  (from Ch. 122, par. 712.1)
7    Sec. 1. Definitions. For the purposes of this Act:
8    "School board" means school principal, directors, board of
9education and board of school inspectors of public and private
10schools.
11    "Welfare center" means an institution not otherwise
12receiving funds from any governmental agency, serving
13breakfasts or lunches to children of school age or under, in
14conformance with the authorized free breakfast program, school
15breakfast program, free lunch program, or school lunch program.
16    "Free breakfast program" means those programs through
17which school boards may supply needy children in their
18respective districts with free school breakfasts.
19    "Free lunch program" means those programs through which
20school boards supply all of the needy children in their
21respective districts with free school lunches.
22    "School breakfast program" means a school breakfast
23program that meets the requirements for school breakfast

1programs under the Child Nutrition Act of 1966 (42 U.S.C. 1771
2et seq.).
3    "School lunch program" means a school lunch program that
4meets the requirements for school lunch programs under the
5National School Lunch Act (42 U.S.C. 1751 et seq.).
6    "Comptroller" means Comptroller of the State of Illinois.

9    Sec. 4. Accounts; copies of menus served; free breakfast
10and free lunch program required; report. School boards and
11welfare centers shall keep an accurate, detailed and separate
12account of all moneys expended for school breakfast programs,
13school lunch programs, free breakfast programs, free lunch
14programs, and summer food service programs, and of the amounts
15for which they are reimbursed by any governmental agency,
16moneys received from students and from any other contributors
17to the program. School boards and welfare centers shall also
18keep on file a copy of all menus served under the programs,
19which together with all records of receipts and disbursements,
20shall be made available to representatives of the State Board
21of Education at any time.
22    Every public school must have a free breakfast program.
23    Every public school must have a free lunch program.
