Amends the School Breakfast and Lunch Program Act. In the definitions of "free breakfast program" and "free lunch program" removes references to needy children. Requires every public school to have a free breakfast program. Repeals provisions concerning a breakfast incentive program and applications for participation in programs.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The School Breakfast and Lunch Program Act is | 5 | | amended by changing Sections 1 and 4 as follows:
| 6 | | (105 ILCS 125/1) (from Ch. 122, par. 712.1)
| 7 | | Sec. 1. Definitions. For the purposes of this Act:
| 8 | | "School board" means school principal, directors, board of | 9 | | education
and board of school inspectors of public and private | 10 | | schools.
| 11 | | "Welfare center" means an institution not otherwise | 12 | | receiving funds
from any governmental agency, serving | 13 | | breakfasts or lunches to children of
school age
or under, in | 14 | | conformance with the authorized free breakfast program, school
| 15 | | breakfast program, free lunch program, or school lunch program.
| 16 | | "Free breakfast program" means those programs through | 17 | | which school
boards may supply needy children in their | 18 | | respective districts with free
school breakfasts.
| 19 | | "Free lunch program" means those programs through which | 20 | | school boards
supply all of the needy children in their | 21 | | respective districts with free
school lunches.
| 22 | | "School breakfast program" means a school breakfast | 23 | | program that
meets the requirements for school breakfast |

Nutrition Act of 1966 (42 U.S.C. 1771 | 2 | | et seq.).
| 3 | | "School lunch program" means
a school lunch program that | 4 | | meets the requirements for school lunch
programs under the | 5 | | National School Lunch Act (42 U.S.C. 1751 et seq.).
| 6 | | "Comptroller" means Comptroller of the State of Illinois.

report. School boards and | 11 | | welfare centers shall keep an accurate, detailed
and separate | 12 | | account of all moneys expended for school breakfast programs,
| 13 | | school lunch programs, free breakfast programs, free lunch | 14 | | programs,
and summer food service programs,
and of the amounts | 15 | | for which they are reimbursed by any governmental agency,
| 16 | | moneys received from students and from any other contributors | 17 | | to the program.
School boards and welfare centers shall also | 18 | | keep on file a copy of all menus
served under the programs, | 19 | | which together with all records of receipts and
disbursements, | 20 | | shall be made available to representatives of the State Board
| 21 | | of Education at any time.
| 22 | | Every public school must have a free breakfast program. | 23 | | Every public school must have a free lunch program.
