SYNOPSIS AS INTRODUCED:
 
15 ILCS 305/21 new

    Amends the Secretary of State Act. Provides that the Secretary of State shall adopt rules to provide for the electronic publication of public records maintained by the Secretary of State Index Department. Provides that the Index Department shall electronically publish public records within 2 business days after receipt of the records. Provides that the rules adopted by the Secretary may provide for the electronic submission of public records. Provides that the rules adopted by the Secretary shall only apply to public records submitted after the effective date of this amendatory Act. Defines "public records". Effective one year after becoming law.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Secretary of State Act is amended by adding
5Section 21 as follows:
 
6    (15 ILCS 305/21 new)
7    Sec. 21. Electronic records publication.
8    (a) The Secretary of State shall adopt rules to provide for
9the electronic publication of public records maintained by the
10Secretary of State Index Department. The Index Department shall
11electronically publish public records within 2 business days
12after of receipt of the records. The rules adopted by the
13Secretary under this Section may provide for the electronic
14submission of public records. The rules adopted by the
15Secretary under this Section shall only apply to public records
16submitted after the effective date of this amendatory Act of
17the 101st General Assembly.
18    (b) For the purposes of this Section, "public records"
19includes any document that must be filed with the Secretary of
20State in accordance with the following statutes: Section 2 of
21the Illinois Constitutional Amendment Act; Section 3.1 of the
22Intergovernmental Cooperation Act; Sections 7A-1, 21-3, 28-8,
23and 28-8.1 of the Election Code; paragraph 2 of Section 5 and

1Section 6a of the Secretary of State Act; the Illinois
2Enterprise Zone Act; Section 845-50 of the Illinois Finance
3Authority Act; Section 2 of the Mental Health Institution Bond

51-3002, 1-4005, 2-2002, and 2-5014 of the Counties Code;
6Sections 1-7-2, 2-1-5, 2-1-6, 2-1-7, 2-4-2, 2-4-3, 2-4-6,

12Corporation Act of 1983; Section 1.5 of the Ticket Sale and
13Resale Act; Section 9 of the Credit Services Organizations Act;
14Section 12 of the Dance Studio Act; and Section 601 of the
15Illinois Fair Invention Development Standards Act.
16    "Public records" also includes certificates of pardon and
17sentence commutation, a certified copy of the decennial census
18taken by the United States Department of Commerce, Bureau of
19the Census, and any corrected or revised census reports, the
20appointments of all public administrators and guardians as
21defined by the Probate Act of 1975, the deeds and leases of all
22property owned or leased by the State, the written disagreement
23or deviation of any Director of the Department of Financial and
24Professional Regulation with the recommendations of one of its
25disciplinary committees, and the legislative appointments to
26any boards, commissions, or special districts created by law.

1    Section 99. Effective date. This Act takes effect one year
2after becoming law.
