SYNOPSIS AS INTRODUCED:

15 ILCS 305/21 new

Amends the Secretary of State Act. Provides that the Secretary of State shall adopt rules to provide for the electronic publication of public records maintained by the Secretary of State Index Department. Provides that the Index Department shall electronically publish public records within 2 business days after receipt of the records. Provides that the rules adopted by the Secretary may provide for the electronic submission of public records. Provides that the rules adopted by the Secretary shall only apply to public records submitted after the effective date of this amendatory Act. Defines "public records". Effective one year after becoming law.

A BILL FOR

AN ACT concerning State government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Secretary of State Act is amended by adding Section 21 as follows:

(15 ILCS 305/21 new)

Sec. 21. Electronic records publication.

(a) The Secretary of State shall adopt rules to provide for the electronic publication of public records maintained by the Secretary of State Index Department. The Index Department shall electronically publish public records within 2 business days after of receipt of the records. The rules adopted by the Secretary under this Section may provide for the electronic submission of public records. The rules adopted by the Secretary under this Section shall only apply to public records submitted after the effective date of this amendatory Act of the 101st General Assembly.

(b) For the purposes of this Section, "public records" includes any document that must be filed with the Secretary of State in accordance with the following statutes: Section 2 of the Illinois Constitutional Amendment Act; Section 3.1 of the Intergovernmental Cooperation Act; Sections 7A-1, 21-3, 28-8, and 28-8.1 of the Election Code; paragraph 2 of Section 5 and Section 6a of the Secretary of State Act; the Illinois Enterprise Zone Act; Section 845-50 of the Illinois Finance Authority Act; Section 2 of the Mental Health Institution Bond Act; Section 7.1 of the State Property Control Act; Sections 1-3002, 1-4005, 2-2002, and 2-5014 of the Counties Code; Sections 1-7-2, 2-1-5, 2-1-6, 2-1-7, 2-4-2, 2-4-3, 2-4-6, 4-2-7, 5-1-10, 6-2-7, 7-6-5, 11-119.1-4, and 11-119.2-4 of the Illinois Municipal Code; the Airport Authorities Act; the Hospital District Law; Section 2 of the Lincoln Park Commissioners Land Condemnation Act; Section 100 of the Alexander-Cairo Port District Act; Section 24 of the Havana Regional Port District Act; Section 105 of the Heart of Illinois Regional Port District Act; Section 13 of the Illinois International Port District Act; Section 33 of the Illinois Valley Regional Port District Act; Section 16 of Jackson-Union Counties Regional Port District Act; Section 15 of the Joliet Regional Port District Act; Section 34 of the Kaskaskia Regional Port District Act; Section 100 of the Massac-Metropolis Port District Act; Section 105 of the Mid-America Intermodal Authority Port District Act; Section 21 of the Mt. Carmel Regional Port District Act; Section 100 of the Ottawa Port District Act; Section 16 of the Seneca Regional Port District Act; Section 16 of the Shawneetown Regional Port District Act; Section 20 of the Southwest Regional Port District Act; Section 16 of the America's Central Port District Act; Section 22 of the Upper Mississippi River International Port District Act; Section 16 of the Waukegan Port District Act; Section 24 of the White County Port District Act; Section 6 of the Sanitary District Act of 1907; Section 4.1 of the Sanitary District Act of 1917; Section 4.2 of the Sanitary District Act of 1936; the Local Mass Transit District Act; Section 4 of the Metro East Solid Waste Disposal and Energy Producing Service Act; Section 466 of the Illinois Insurance Code; Section 3 of the Art Auction House Act; Section 9-2 of the Liquor Control Act; Section 21.5 of the Illinois Low-Level Radioactive Waste Management Act; Section 23 of the Uniform Criminal Extradition Act; Section 1.70 of the Business Corporation Act of 1983; Section 1.5 of the Ticket Sale and Resale Act; Section 9 of the Credit Services Organizations Act; Section 12 of the Dance Studio Act; and Section 601 of the Illinois Fair Invention Development Standards Act.

"Public records" also includes certificates of pardon and sentence commutation, a certified copy of the decennial census taken by the United States Department of Commerce, Bureau of the Census, and any corrected or revised census reports, the appointments of all public administrators and guardians as defined by the Probate Act of 1975, the deeds and leases of all property owned or leased by the State, the written disagreement or deviation of any Director of the Department of Financial and Professional Regulation with the recommendations of one of its disciplinary committees, and the legislative appointments to any boards, commissions, or special districts created by law.

Section 99. Effective date. This Act takes effect one year after becoming law.
