SYNOPSIS AS INTRODUCED:

405 ILCS 5/3-200.5 new

Amends the Mental Health and Developmental Disabilities Code. Provides that no adult person who is diagnosed as a person with an intellectual disability or a person with a developmental disability may be discharged from a hospital, or similar facility, and transferred to a mental health facility, or any portion thereof, without first notifying a parent or guardian of that individual.

AN ACT concerning health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Mental Health and Developmental Disabilities Code is amended by adding Section 3-200.5 as follows:

(405 ILCS 5/3-200.5 new)

Sec. 3-200.5. Notice of adult involuntary transfer. No adult person who is diagnosed as a person with an intellectual disability or a person with a developmental disability may be discharged from a hospital, or similar facility, and transferred to a mental health facility, or any portion thereof, without first notifying a parent or guardian of that individual.
