SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2WWW new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a medical alert system operator to attempt to impose liability upon a person not a party to a contract upon the death of the person who is a party to the contract. Effective immediately.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Consumer Fraud and Deceptive Business
5Practices Act is amended by adding Section 2WWW as follows:
 
6    (815 ILCS 505/2WWW new)
7    Sec. 2WWW. Medical alert services.
8    (a) As used in this Section, "medical alert system
9operator" means a person that operates a service that enables a
10consumer to obtain assistance by initiating contact with the
11medical alert system operator by means of activating a device
12made available by the medical alert system operator under a
13contract that requires periodic payments by the consumer.
14    (b) A medical alert system operator may not, upon the death
15of the consumer under contract with the operator, impose or
16seek to impose liability for the unexpired term of the contract
17upon any person other than a party to the contract.
18    (c) A violation of this Section constitutes an unlawful
19practice within the meaning of this Act.
 
20    Section 99. Effective date. This Act takes effect upon
21becoming law.
