SYNOPSIS AS INTRODUCED:
 
815 ILCS 325/3  from Ch. 121 1/2, par. 323

    Amends the Recyclable Metal Purchase Registration Law. In a provision requiring recyclable metal dealers to enter certain information into an electronic record-keeping system for each purchase of recyclable metal or recyclable metal containing copper, requires recyclable metal dealers to provide a description of the recyclable metal purchased including its weight to the nearest tenth of a pound. Effective January 1, 2021.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Recyclable Metal Purchase Registration Law
5is amended by changing Section 3 as follows:
 
6    (815 ILCS 325/3)  (from Ch. 121 1/2, par. 323)
7    Sec. 3. Records of purchases. Except as provided in Section
85 of this Act every recyclable metal dealer in this State shall
9enter into an electronic record-keeping system for each
10purchase of recyclable metal or recyclable metal containing
11copper the following information:
12        1. The name and address of the recyclable metal dealer;
13        2. The date and place of each purchase;
14        3. The name and address of the person or persons from
15    whom the recyclable metal was purchased, which shall be
16    verified from a valid driver's license or other
17    government-issued photo identification. The recyclable
18    metal dealer shall make and record a photocopy or
19    electronic scan of the driver's license or other
20    government-issued photo identification. If the person
21    delivering the recyclable metal does not have a valid
22    driver's license or other government-issued photo
23    identification, the recyclable metal dealer shall not

1    complete the transaction;
2        4. The motor vehicle license number and state of
3    issuance of the motor vehicle license number of the vehicle
4    or conveyance on which the recyclable metal was delivered
5    to the recyclable metal dealer;
6        5. A description of the recyclable metal purchased,
7    including the weight to the nearest tenth of a pound and
8    whether it consists of bars, cable, ingots, rods, tubing,
9    wire, wire scraps, clamps, connectors, other
10    appurtenances, or some combination thereof;
11        6. Photographs or video, or both, of the seller and of
12    the materials as presented on the scale; and
13        7. A declaration signed and dated by the person or
14    persons from whom the recyclable metal was purchased which
15    states the following:
16            "I, the undersigned, affirm under penalty of law
17        that the property that is subject to this transaction
18        is not to the best of my knowledge stolen property.".
19    A copy of the recorded information shall be kept in an
20electronic record-keeping system by the recyclable metal
21dealer. Purchase records shall be retained for a period of 3
22years. Photographs shall be retained for a period of 3 months
23and video recordings shall be retained for a period of one
24month. The electronic record-keeping system shall be made
25available for inspection by any law enforcement official or the
26representatives of common carriers and persons, firms,

1corporations or municipal corporations engaged in either the
2generation, transmission or distribution of electric energy or
3engaged in telephone, telegraph or other communications, at any
4time.

7    Section 99. Effective date. This Act takes effect January
81, 2021.
