SYNOPSIS AS INTRODUCED:
 
820 ILCS 75/17 new

    Amends the Job Opportunities for Qualified Applicants Act. Provides that a person may not be placed on a do-not-hire list unless the person has committed an violent crime or unless the specific employment opportunity will require the person to exercise fiduciary responsibility. Requires annual reevaluation of persons on a do-not-hire list.

1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Job Opportunities for Qualified Applicants
5Act is amended by adding Section 17 as follows:
 
6    (820 ILCS 75/17 new)
7    Sec. 17. Do-not-hire lists.
8    (a) An employer or employment agency that maintains a
9do-not-hire list may not include an individual on that list
10unless the individual has committed a violent crime or unless
11the specific employment opportunity requires the employee to
12exercise fiduciary responsibility.
13    (b) An employer or employment agency that maintains a
14do-not-hire list must annually reevaluate the persons on the
15list to ascertain whether the persons should remain on the
16list.
17    (c) In this Section, "violent crime" has the meaning
18ascribed to that term in the Rights of Crime Victims and
19Witnesses Act.
