SYNOPSIS AS INTRODUCED:
 
30 ILCS 500/30-50

    Amends the Illinois Procurement Code. Provides that, when a contract entered into by any State agency (currently, the Department of Transportation only) provides for mobilization payments and the contractor is using the services of a subcontractor, the subcontract shall include terms requiring mobilization payments be made to the subcontractor. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Procurement Code is amended by
5changing Section 30-50 as follows:
 
6    (30 ILCS 500/30-50)
7    Sec. 30-50. Mobilization payments.
8    (a) As used in this Section, "mobilization payment" means
9an advance payment for the preparatory work and operations
10necessary for the movement of personnel, equipment, supplies,
11and incidentals to a project site and for all other work or
12operations that must be performed or costs incurred when
13beginning work on a project.
14    (b) When a contract under this Code entered into by any
15State agency the Department of Transportation provides for
16mobilization payments and the contractor is using the services
17of a subcontractor, the subcontract shall include terms
18requiring mobilization payments be made to the subcontractor.
19    Mobilization payments to a subcontractor shall be made on a
20tiered system based on the initial value of the subcontract:

22Less than $10,000 25%
23$10,000-$19,999 20%
