605 ILCS 5/4-210  from Ch. 121, par. 4-210

    Amends the Illinois Highway Code. Provides that the Department of Transportation may allow entrances to farm fields with a maximum width of 40 feet. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by changing
5Section 4-210 as follows:
 
6    (605 ILCS 5/4-210)  (from Ch. 121, par. 4-210)
7    Sec. 4-210. Except where the right of access has been
8limited by or pursuant to law every owner or occupant of
9property abutting upon any State highway shall have reasonable
10means of ingress from and egress to the State highway
11consistent with the use being made of such property and not
12inconsistent with public safety or with the proper construction
13and maintenance of the State highway for purposes of travel,
14drainage and other appropriate public use. The Department is
15authorized to adopt and to amend reasonable and necessary
16rules, regulations and specifications covering standard
17entrance or exit driveways to serve residential, farm,
18commercial, industrial, and roadside service establishments
19and other uses of property abutting upon State highways
20including specifications for drainage and other structures
21appurtenant to such driveways. The Department may allow
22entrances to farm fields with a maximum width of 40 feet. No
23permit shall be issued by the Department for the construction

1of any such driveway which does not conform to the applicable
2standard prescribed by the Department unless the application
3therefor is accompanied by drawings of and specifications for
4the proposed construction and a showing of reasonable need for
5departure from the applicable standard type of driveway
6prescribed by the Department nor unless it is made to appear
7that the proposed construction and the use thereof will not be
8inconsistent with public safety and use nor with the proper
9construction and maintenance of the highway and its drainage
10and other facilities.

12    Section 99. Effective date. This Act takes effect upon
13becoming law.
