SYNOPSIS AS INTRODUCED:
 
405 ILCS 5/3-606  from Ch. 91 1/2, par. 3-606

    Amends the Mental Health and Developmental Disabilities Code. Provides that a peace officer may take a person into custody and transport the person to a mental health facility if the peace officer has administered an opioid antagonist to the person in response to an opioid overdose. Defines "opioid antagonist".

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mental Health and Developmental
5Disabilities Code is amended by changing Section 3-606 as
6follows:
 
7    (405 ILCS 5/3-606)  (from Ch. 91 1/2, par. 3-606)
8    Sec. 3-606. (a) In this Section, "opioid antagonist" has
9the meaning ascribed to it in paragraph (4) of subsection (d)
10of Section 5-23 of the Substance Use Disorder Act.
11    (b) A peace officer may take a person into custody and
12transport him to a mental health facility when the peace
13officer has reasonable grounds to believe that the person is
14subject to involuntary admission on an inpatient basis and in
15need of immediate hospitalization to protect such person or
16others from physical harm or if the peace officer has
17administered an opioid antagonist to the person in response to
18an opioid overdose. Upon arrival at the facility, the peace
19officer may complete the petition under Section 3-601. If the
20petition is not completed by the peace officer transporting the
21person, the transporting officer's name, badge number, and
22employer shall be included in the petition as a potential
23witness as provided in Section 3-601 of this Chapter.
