AMENDMENT TO HOUSE BILL 1763 

2    AMENDMENT NO. ______. Amend House Bill 1763 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Consumer Fraud and Deceptive Business 
5Practices Act is amended by adding Section 2HHHH as follows:
 
6    (815 ILCS 505/2HHHH new)
7    Sec. 2HHHH. Social clubs; delinquent members. 
8    (a) As used in this Section, "social club" means a private 
9establishment that is the premises of a formal organization of 
10members for pleasure, recreation, and other purposes. "Social 
11club" does not include a fitness center or a community pool.
12    (b) A social club shall not charge a member who is 
13delinquent or in poor standing with the club for the time the 
14member is not allowed in the club or is unable to access the 
15club's services. A contract that violates this subsection is 
16void and unenforceable.

1    (c) This Section shall not apply to any contract entered 
2into prior to the effective date of this amendatory Act of the 
3104th General Assembly.
4    (d) A violation of this Section constitutes an unlawful 
5practice within the meaning of this Act.
 
6    Section 99. Effective date. This Act takes effect upon 
7becoming law.".
