Synopsis As Introduced
Amends the Illinois Roofing Industry Licensing Act. In provisions concerning the display of license number and advertising, specifies that the licensee must display the roofing contractor license number and the licensee's name, as it appears on the license. Provides that if an applicant applies for a building permit with a unit of local government and knowingly submits a roofing license number that is not that of the roofing contractor who performs the work on the roofing portion of the project for which the applicant has requested the permit, then the applicant shall be guilty of identity theft under the Criminal Code of 1961. Effective immediately.

House Committee Amendment No. 1
Adds reference to:
720 ILCS 5/16G-15

Deletes everything after the enacting clause and reinserts the bill as introduced, with the following changes: Amends the Criminal Code of 1961; adds provision that a person commits the offense of identity theft when he or she knowingly, in the course of applying for a building permit with a unit of local government, provides the license number of a roofing contractor whom he or she does not intend to have perform the work on the roofing portion of the project; provides that it is an affirmative defense to prosecution under the provision that the building permit applicant promptly informed the unit of local government that issued the building permit of any change in the roofing contractor; provides that a person who commits identity theft under the provision shall be guilty of a Class 4 felony. Amends the Illinois Roofing Industry Licensing Act; provides cross-reference to the criminal penalty for identity theft under the Criminal Code of 1961. Effective immediately.
