Synopsis As Introduced
Amends the Day and Temporary Labor Services Act. Provides that a day and temporary labor service agency or a third party client or a contractor or agent of either may charge a fee to transport a day or temporary laborer to or from a designated work site of up to 4% of the straight time daily wages earned for transportation to a work site and 4% of the straight time daily wages earned for transportation from the work site back to the agency's office. Provides that if a third party client's hours of work report that is given to a day and temporary labor service agency for a laborer includes payroll information covering more than one day in the work week, the day and temporary labor service agency may show on the paycheck stub or other approved form the combined number of hours worked for that client in the week rather than the hours worked each day. Provides that a deduction from a day or temporary laborer's wages for transportation is permitted even if the deduction causes the laborer's hourly wage to fall below the State or federal minimum wage if the day or temporary laborer provides a written authorization for the transportation deduction at the time the transportation service is provided.

Replaces everything after the enacting clause, and re-inserts language providing that if a third party client's hours of work report that is given to a day and temporary labor service agency for a laborer includes payroll information covering more than one day in the work week, the day and temporary labor service agency may show on the paycheck stub or other approved form the combined number of hours worked for that client in the week rather than the hours worked each day.

Deletes everything after the enacting clause and makes the following changes. Changes the definition of "day and temporary labor" to work performed by a day or temporary laborer at a third party client, the duration of which may be specific or undefined, pursuant to a contract or understanding between the day and temporary labor service agency and the third party client. In provisions requiring a day and temporary labor service agency to keep specified records when it sends a day or temporary laborer to work for a third party client, provides that "the third party client shall be required to remit all information required under this subsection to the day and temporary labor service agency no later than 7 days following the last day of the work week worked by the day or temporary laborer" and "failure of a third party client to remit such information to a day and temporary labor service agency shall not be a defense to the recordkeeping requirement". Provides that failure by a third party client to remit time records to the day and temporary labor service agency in accordance with specified requirements constitutes a notice violation by a third party client under the Act unless the third party client has been precluded from submitting the time records for reasons beyond its control, and that a failure by the third party client to provide time records in accordance with specified requirements is not a notice violation and shall not be the basis for a suit or other action under specified provisions of the Act against the day and temporary labor service agency. Provides that failure to receive the information from the third party client is no defense to specified recordkeeping requirements. In provisions requiring a day and temporary to include the number of hours worked by the day or temporary laborer in the itemized statement it gives to a day or temporary laborer, provides that if the day or temporary laborer is assigned to work at the same work site of the same third party client for multiple days in the same work week, the day and temporary labor service agency may record a summary of hours worked at that third party client's worksite so long as the first and last day of that work week are identified as well. Makes other changes. Effective immediately.
