Synopsis As Introduced
Amends the Election Code. Provides that when a political party committee fills a vacancy in nomination occurring because no candidate's name appeared on the consolidated primary ballot and no write-in candidate was nominated, the committee must do so within 16 days after the primary. In the case of a vacancy in nomination that occurs because the name of a political party's candidate did not appear on the general primary ballot and no write-in candidate was nominated, provides that the vacancy may be filled only by a person selected by the party committee within 60 days after the primary who circulates and files petitions for that office in the same manner as an independent candidate (now, by a person nominated by the committee within 60 days after the general primary).

House Floor Amendment No. 1
Removes the bill's requirement that a vacancy in nomination created when no candidate's name appeared on the consolidated primary ballot and no write-in candidate was nominated must be filled within 16 days after the day of the consolidated primary.

Senate Floor Amendment No. 1
Replaces the substantive provisions of the bill. Amends the Election Code to provide that a vacancy in nomination shall be filled only by a person designated by the appropriate committee of the political party and only if that designated person files nominating petitions with the number of signatures required for an established party candidate for that office within 75 days after the day of the general primary. The circulation period for those petitions begins on the day the appropriate committee designates that person. The person must file his or her nominating petitions, statements of candidacy, notice of appointment by the appropriate committee, and receipt of filing his or her statement of economic interests together. Provides that the State Board of Elections shall hear and pass upon all objections to nomination petitions filed by candidates under these provisions.

Governor Amendatory Veto Message
Recommends that the Election Code be further amended to require that the 2010 general primary election ballot contain an advisory question as to whether the Illinois Constitution should be amended to permit adoption of standards of ethical conduct for State officials and employees by initiative petitions and binding referenda. Exempts the advisory question from the Code's limit on the number of questions per election. Adds an immediate effective date.
