Synopsis As Introduced
Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Illinois Insurance Code, the Health Maintenance Organization Act, and the Voluntary Health Services Plans Act to require the continuation of coverage for a dependent college student who takes a medical leave of absence or reduces his or her course load to part-time status because of an illness or injury.

House Floor Amendment No. 1
Changes the provisions amending the Illinois Insurance Code. Provides that the medical leave of absence or reduction in course load must be because of a catastrophic illness or injury. Provides that continuation of coverage is subject to all of the policy's terms and conditions applicable to those forms of insurance and shall terminate 12 months after notice of the illness or injury or until the coverage would have otherwise lapsed pursuant to the terms and conditions of the policy, whichever comes first, provided the need for part-time status or medical leave of absence is supported by a clinical certification of need from a physician licensed to practice medicine in all its branches. Provides that the provisions do not apply to short-term travel, accident-only, limited, or specified disease policies or to policies or contracts designed for issuance to persons eligible for coverage under Title XVIII of the Social Security Act, known as Medicare, or any other similar coverage under State or federal governmental plans.

Governor Amendatory Veto Message
Adds reference to: 215 ILCS 5/356z.12 new- Recommends that the Illinois Insurance Code be further amended to provide that policies of accident and health insurance or managed care plans that cover dependents shall not terminate or deny election of coverage for an unmarried dependent due to age before the dependent’s 26th birthday. Provides that policies or plans shall have an initial enrollment period of at least 90 days during which an insured may elect for coverage of an unmarried dependent. Provides criteria for an unmarried dependent to be eligible for coverage. Provides that policies of accident and health insurance or managed care plans that cover dependents shall not terminate or deny election of coverage for an unmarried dependent due to age before the dependent’s 30th birthday if the dependent meets certain military service requirements. Provides that a policy or plan subject to the Illinois Insurance Code shall not condition eligibility for dependent coverage on enrollment in any educational institution. Contains other provisions.
