Synopsis As Introduced
Amends the Criminal Code of 1961. Makes a technical change in a Section concerning an affirmative defense to retail theft.

House Committee Amendment No. 1
Deletes reference to:
720 ILCS 5/16A-6
Adds reference to:
New Act

Adds a preamble to the bill. Deletes everything after the enacting clause. Creates the Illinois Torture and Relief Inquiry Commission. Provides that the Illinois Torture Relief Inquiry Commission shall be an independent commission under the Administrative Office of the Illinois Courts for administrative purposes. Provides that the Commission shall study torture committed by John Burge and other officers. Effective immediately.

Senate Committee Amendment No. 1
Reinserts the provisions of the engrossed bill. Provides that the Illinois Torture Inquiry and Relief Commission shall be an independent agency under the Illinois Human Rights Commission rather than the Administrative Office of the Illinois Courts. Changes the terms of appointment of the Illinois Torture Inquiry and Relief Commission. Provides that the Executive Director of the Illinois Human Rights Commission must obtain a signed agreement from the convicted person seeking an inquiry into a claim of torture that the convicted person waives his or her right against self-incrimination under the U.S. and Illinois Constitutions. Provides that the records and proceedings of the Illinois Torture Inquiry and Relief Commission shall be confidential until the proceedings before the Commission are concluded and a final decision has been made by the Commission. Provides that the Act applies to claims of torture filed not later than 5 years after the effective date of the Act. Makes other changes. Effective immediately.

Senate Floor Amendment No. 2
Provides that specified Commission meetings and hearings shall be held in accordance with the Open Meetings Act. Provides that all records (instead of records and proceedings) of the Commission shall be confidential until the proceedings before the Commission are concluded and a final decision has been made by the Commission.
