Synopsis As Introduced
Amends the Humane Care for Animals Act to prohibit destruction of an animal by decompression chamber and lowering the oxygen pressure or by using nitrous oxide, halothane, carbon monoxide, or carbon dioxide. Imposes criminal penalties for violation. Amends the Humane Euthanasia in Animal Shelters Act. Changes the short title to the Humane Animal Euthanasia Act. Contains provisions concerning renewal of a euthanasia technician certificate and continuing education; restrictions on issuing certificates because of felony convictions; euthanasia methods; refusal to renew and revocation of euthanasia technician and euthanasia agency certification; exemptions from certification; and criminal penalties. Amends other Acts to make conforming changes.

Contains provisions concerning renewal of a euthanasia technician certificate and continuing education; restrictions on issuing certificates because of felony convictions; euthanasia methods; refusal to renew and revocation of euthanasia technician and euthanasia agency certification; exemptions from certification; and criminal penalties.

House Committee Amendment No. 2
Provides that certain alleged criminal violations shall be referred to the State's Attorney in the county in which the violation occurred (instead of to the State's Attorney in the county in which the violation occurred or to the Illinois Attorney General's office).

Replaces everything after the enacting clause. Reinserts the provisions of House Amendment No. 1 with changes. In the Humane Care for Animals Act, removes the provisions concerning prohibited methods of euthanasia of a companion animal and instead provides (i) that euthanasia by carbon monoxide is prohibited unless performed by a licensed veterinarian and (ii) that use of a decompression chamber or carbon dioxide is prohibited. Provides criminal penalties for violation. Sets forth requirements for a veterinarian to be eligible for the exemption. In the Humane Euthanasia in Animal Shelters Act, (i) restores the requirement that to qualify as a euthanasia technician certain licenses or certifications must have been issued within 3 years before the date of the application and (ii) provides for criminal penalties to be enforced by the State’s Attorney (instead of the State’s Attorney or the Attorney General).

House Floor Amendment No. 4
Further amends the Humane Care for Animals Act and the Humane Euthanasia in Animal Shelters Act. Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion. Further amends the Humane Euthanasia in Animal Shelters Act. Provides that a licensed veterinarian may euthanize companion animals in an animal shelter or animal control facility by the use of carbon monoxide if the veterinarian complies with the requirements set forth in the Humane Care for Animals Act for euthanasia by that method.
