Synopsis As Introduced
Amends the Ambulatory Surgical Treatment Center Act. Provides that on and after the effective date of this amendatory Act, no license shall be granted or renewed under the Ambulatory Surgical Treatment Center Act until the applicant seeking the license submits to the Department of Public Health, and the Department approves, a plan for the service of medically underserved populations that details for each of the facility's next 5 years of operation (i) the proportion of its total projected patients in the categories of indigent and Medicaid recipients and (ii) how the facility will serve those patients. Requires the Department to adopt rules for implementing the requirement of a plan for the service of medically underserved populations, including the development of appropriate minimum proportions of facility patients in the categories of indigent and Medicaid recipients. Effective immediately.

Senate Floor Amendment No. 1
Replaces the amendatory provisions of the bill concerning the granting and renewal of licenses under the Ambulatory Surgical Treatment Center Act. Provides that on and after the effective date of this amendatory Act, no license shall be granted or renewed unless the applicant: (i) submits, and the Department of Public Health approves, a plan for providing service to Medicaid recipients and medically underserved populations in its service area; or (ii) submits a plan for charity care that has been approved by the Illinois Attorney General; or (iii) submits a notarized statement signed by the Chief Executive Officer of the organization certifying that the applicant will not refuse service to any patient because the services the patient seeks may be reimbursed under Medicaid. Provides that in addition, no license shall be granted or renewed if the Department determines that the applicant has not complied with a prior plan or notarized statement submitted pursuant to these provisions.

 There are currently 132 licensed Ambulatory Surgical Treatments Centers. The review and approval of plans will require 1 RN/FTE at a cost of $106,565. A contract may be needed to establish the proportion plan/criteria. Cost for contracts is unknown.

Deletes everything after the enacting clause. Amends the Comprehensive Health Insurance Plan Act. Adds a provision requiring that the Plan provide coverage for mammograms and prosthetic devices or reconstructive surgery incident to a mastectomy, Pap tests, prostate-specific antigen tests, colorectal cancer examination and screening, and contraceptives as required under certain Sections of the Illinois Insurance Code. Provides that any expense or charge for routine physical examinations or tests related to certain covered benefits are not excluded from coverage under the Plan. Deletes a provision excluding any expense or charge for oral contraceptives used for birth control or any other temporary birth control measures from coverage under the Plan. Imposes conditions on any rulemaking authority.
