Synopsis As Introduced
Amends the Trusts and Trustees Act. Provides that by accepting a benefit under a trust instrument, the beneficiary admits the instrument to be a valid trust. Provides that a beneficiary of a trust may not accept a benefit under the instrument and at the same time set up a claim which is contrary to the substantive terms of the trust.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause with the provisions of the introduced bill, and makes the following changes: (i) specifies that the provisions govern a person accepting a benefit under a trust instrument designed to achieve the effect of testation (instead of a "trust instrument"); and (ii) provides that exceptions applicable to the doctrine of election as applied to wills also apply to trusts.
