Synopsis As Introduced Creates the Employee Paid Health Care Time Act. Provides that employees shall accrue paid health care time at a rate of not less than one hour for every 22 hours worked for an employer with 50 or more employees and at a rate of one hour for every 40 hours worked for an employer with fewer than 50 employees. Sets forth purposes for which paid health care time may be used. Applies to employers employing one or more individuals. Prohibits retaliation by employers. Defines terms. Provides that a violation by an employer is a petty offense with a fine of $500. Effective July 1, 2015.

The Department of Labor currently employs 8 wage claim specialists and clerical staff to process and administer on average upwards of 4000 wage claims under the Wage Payment and Collection Act. With passage of this bill, the Department will need to add at least 4 full time staff members to process, answer phone calls and emails, and investigate additional claims. Also, at least one additional attorney position to review the additional claims for legal sufficiency and to ensure that the proper responsible parties are named. In addition, two administrative law judges would also be needed to handle the increase in the number of administrative hearings as a result of the additional claims. There are other administrative costs, including postage, office supplies and new employee IT equipment and licensing. Fiscal Impact = $800,000 (7 Headcount = $751,900, Administrative Costs = $48,100).
